Hello all,
I have been receiving this mails from 'Allgemeiner Debitoren und Inkassodienst GmbH' about paying for a magazine which I never bought.

Short history: I started receiving their emails back in august 2024 as far as I remember and ignored for a while but then after receiving their email for the third time about paying up my debt (which doesn't exist btw).

First I ignored it because the name and address in the emails were incorrect, the name was not my official name, they used my name which I use on social media and my last address, which I already left in april 2024.

So the lawyer told me to write them a letter and stating (see 3rd picture).
And today I received another letter from them threatening me with a court order if I didn't pay till 13th march. I tried to book an appointment with the lawyer but the next available appointment is on 14th march.

What should I do now?

    wait and talk to your lawyer, you did exactly what he told you to do, law is really slow in germany. i had to fight for an entire year to get my caution back from my previous landlord. even if they will send this to the court the court will give you a chance to justify this and you can write a nice explanation with your lawyer and it’s most likely done.

  2. Nobody writes like that Ich hab hier den “Antrag zur Einleitung eines Gerichtlichen Mahnverfahrens” liegen… But pls pay before that…

    Ignore it keep it. and if and that is only if they write a Gerichtlicher Mahnbescheid which is the yellow letter with Postzustellurkunde refute the charge then and there…

  3. Nothing. Don’t let them intimidate you. They want money from you, so they need to prove you owe them. If you’re absolutely certain you never signed up for anything, then let them come at you, they’ll fail in court.

    Also make that appointment on the 14th and talk to your lawyer. IANAL.

So maybe try this letter?

  6. Apart from the whole PVZ topic:
    I had to do with ADU Inkasso once a few years ago because I actually forgot to pay something. Their fee calculations (and fees in general) are not legal for the most and they couldn’t show me their mandate, so you probably won’t have to pay solely for that reason.
