Hey everyone,

I worked for a company in Germany for six months, and things didn’t end well with my employer. Now, he’s trying to cause trouble for me by asking me to “correct” my submitted working hours, claiming they don’t match his records. The issue is that there was no proper time tracking system—only security cameras.

I personally tracked my hours weekly, making sure I worked 40 hours by staying late or working on weekends when needed. Now, he expects me to remember and track each individual day over the past six months, even though at the start of my job, he never mentioned that I needed to do this.

From what I understand, under § 16 ArbZG, it’s the employer’s responsibility to track working time, not mine. Am I legally required to adjust my hours based on his assumptions? Could this cause any issues for me?

Would really appreciate advice from anyone familiar with German labor law. Thanks!

  1. How did you track your time? Did you write it down? Then that’s good.

    Also if it’s true that they only have security camera i think (THINK, i’m not a lawyer) it’s not allowed for them to check you working and stuff without any reason?

    I’d suggest get a lawyer..

  2. Your lunch break does not count as working hour. I think that is what it is about.

  3. I’d ask to see their evidence and records so you can review them for accuracy but that might just be me being petty.

  4. Ignore. The burden to report proper working hours to the Finanzamt is only on him, you don’t have to track the working hours on your own and definitely you won’t get into any trouble if what you’re saying is true.
