Hi,

I had my car in a workshop. After picking it up, I discovered that they forgot to put oil in the differential, which caused serious damage. After I pointed it out, they agreed to repair the issue at their expense.

However, they have now sent me an email asking me to sign an Abtretungserklärung (assignment of claims) so they can receive compensation from the insurance company. The document states that if the insurance does not pay, I will be responsible for the costs. Or am I wrong?

This seems strange to me since the issue was clearly their fault. Has anyone experienced something similar? Is it safe to sign this document, or should I refuse?

  1. Yep… there is a large I will pay… section. If they said the repair is on them, i would not sign it

  2. Not a lawyer but i imagine they are using their own insurance to pay for the mistake which makes sense. Unless they are trying to charge YOUR insurance which would be a red flag. Likewise, they should be paying their deductible and any overages that their insurance won’t cover, not YOU.

    The terminology used in this document is normally used if you have had an actual car accident and now have claims against the other driver’s insurance company.

    I would not sign it and maybe look for a lawyer.

  4. I am not a lawyer, but you quite obviously need one. They made a mistake and want to charge you or your insurance for that. If that is truly the case, lawyer up!
