The real fight begins. What happens if the administration ignores the Supreme Court?
I’m shocked they did and hope they get the guy back.
No dissents.
This is the first constitutional test. If he doesn’t bring him back will congress act? I don’t have faith they will
I have to admit that I’m surprised by this, but this is fantastic news.
Now we wait to see it Trump does it or flagrantly and publicly stomps another guardrail.
If it was a mistake why not just fix it? How hard can it be?
If all 9 of them, including that bastard Clarence Thomas, tells them to bring back that man, damn what a fuck up this has become.
“But the Supreme Court in its decision told a federal district court judge in Maryland to clarify his order that the administration “effectuate” the return of Abrego Garcia.”
So, they still gave them a lane to delay it, yes?
“The intended scope of the term “effectuate” in the District Court’s order is, however, unclear, and may exceed the District Court’s authority.”
They’re 100% going to ignore the order and appeal again. This was just SCOTUS trying to punt it.
And now we find out that Kilmar Abrego Garcia died in a tragic accident and the body is unrecoverable.
It would have been cheaper to give everyone their due process.
Calm down everyone. It only says they have to facilitate. The White House press secretary will soon inform us all that it doesn’t say they had to succeed.
Nope, this isn’t yet a win. They have sent it back to the lower court to clarify:
>The intended scope of the term “effectuate” in the District Court’s order is, however, unclear, and may exceed the District Court’s authority. The District Court should clarify its directive, with due regard for the deference owed to the Executive Branch in the conduct of foreign affairs.
Sounds like they are suggesting the lower court can NOT make the gov’t bring him back.
eta: why is there a difference in “effectuate” and “facilitate”? Any legal people got insight?
I totally did not see that coming. I truly thought the Trump court would rule with the administration. They aren’t exactly non-partisan and most of them have a truly one sided interpretation of law.
The whole argument of “we can’t force El Salvador to send him back” is total bs too. That El Salvador president took 200 people for 6 million dollars. Just offer him a million to send one back.
If that guy ever gets back to the USA I hope he sues the diharrea out of the administration and never has to work another day in his life.
I wonder if Fox will even report this.
So this is actually a key moment. The Supreme Court ruled to bring him back.
Will Trump ignore the Supreme Court ruling? What happens if and when he does? What happens if they say they can’t get him back, can’t be found, or is already dead?
Will be interesting to see how this shapes out and will give us a big idea on how to proceed moving forward as it could make it clear that checks and balances are fully out the window. If that’s the case, then we need to be all in on more drastic civil disobedience actions as some were saying.
No dissents even from the likes of Alito and Thomas. That’s the part that stuns me the most.
If he ignores the Supreme Court, he needs to get fired…..some way.
This should have its own mega thread. This is huge news and potentially a preview to the fully line-crossed constitutional crisis. 9-0 the court agreed that this administration broke (knowingly I’d argue) the fifth amendment right to due process against this legal resident (legal status having nothing to do with his constitutional protections).
We need to be screaming this story from the rooftops. What happens next will be history.
I’m surprised by the unanimous decision based off of the current political climate. That being said it should not be this difficult to stop our president from engaging in human trafficking people in this country to some of the most inhumane prisons in the world.
Okay but include the gay hairdresser that was wrongfully deported too. I mean might as well bring everyone back at this point and give them their ENTITLED DUE PROCESS.
Because fucking duh. This better have been a unanimous decision or those morons should turn in their gavels and get maga hats
Been awhile since we’ve seen a 9-0 decision
Hey, they did a good thing. Just the one…but let’s see if they manage another sometime.
9-0 is legitimately crazy. Rare Alito and Thomas W
It’s not deportation since there was no due process. I know this may seem like semantics, but I ain’t fixing to let those jerks whitewash this crap.

A tiny sliver of sanity in the current US debacle.
It is incredible that this actually had to go to the SCOTUS. Just imagine.
Guarantee you this dude did not have “become the poster child for illegal deportations” on his bingo card. He deserves an incredibly warm welcome, and every penny of the money from his eventual lawsuit against the dump administration.
I hope he sues and gets a huge check. That’s is if he’s alive.
I believe the response that is warranted is, “get rekt”
