Without reading around this *too* deeply: this strikes me as a fairly similar regime to that which existed prior to 2002, where the Home Secretary was entitled to set the minimum tariff for those sentenced to life imprisonment. That regime was struck down by the House of Lords in *R (Anderson) v Home Secretary* [2002] UKHL 46, as a breach of the offender’s Article 6 right to a fair trial.

    Although we are about to get a “British Bill of Rights” to replace the ECHR, so who knows whether such a right will exist in any recognisable form in the near future.

  3. Well I’m sure all those people who keep complaining about the lax parole boards letting all those “dangerous criminals” out onto the streets rather than just illegally denying them release, are going to come out in support of this right?
