  1. Holy shit the amount of time and energy spent on oppressing a tiny minority is sickening. And this is clearly just to put down trans women as they’ve completely forgotten about trans men. They will regret if they continue this path and see bearded trans men having to go into women’s bathrooms.

  2. And this is why I’d refuse to live and work in the UK if I ever got the opportunity. I know they’re looking for chemists at the moment, but it certainly won’t be me filling that gap. My current lab tech overlord is a trans woman who also is a friend of a friend.

  3. I guess it’s easy money for trans men then? Be someone like Buck Angel, dress as intimidating as you can(maybe a biker outfit of sorts), go into women’s toilets, and wait until police gets called on you and you wrongly get arrested, sue the state for damages.

    Most likely not how it works, but I would pay to see some gigchad trans guy attempt that, at least for the sake of proving that transphobes are very braindead.

  4. I don’t understand why this has to be such a problem. Just make bathrooms unisex. Boom, done, there’s no problem.

    Most bathrooms are unisex here in Sweden and it works out fine. It’s basically only gendered in night clubs and shopping centres. Not really sure why it’s not unisex in the last one. Could easily be there as well.

  5. The UK is super tolerant and super liberal, and this isn’t going to change because of this ruling. This ruling, aided by a suspiciously well-funded campaign and possibly biased judge, was well-worded and called for reasonable behaviour, but of course that went straight in one ear and out the other when it came to the reaction of the winning side.

    X and Y chromosome complexities aside, science aside, they’re going to end up with men in their public bathrooms.

    Laws can and will be changed, the fights are only just beginning.

  7. Absolutely bonkers the amount of time the Western world spends on this as we plunge into a period of deep crisis and instability and soon enough ecological breakdown. If a trans man wants to use the mens bathroom I don’t care, they certainly aren’t going to ruin the vibe of the McDonald’s bathroom I had to go in this morning that had a giant ass turd in the urinal.

  8. The Equality Act states that trans people can be excluded from single sex services if it is a “proportionate response to a legitimate concern”.

    Following the Supreme Court ruling, the EHRC and government seem to be overriding the Act by implying that trans (and intersex) people are permanently prohibited from any single sex space other than according to their AGAB.

    They then handwave toilets by seemingly advocating for businesses to move towards individual unisex toilets (so each door leads to a single toilet, basin and dryer), but offering no indication of how trans people are expected to use changing facilities etc.

    IIRC, the judges briefly mentioned trans men in their ruling by arguing they could be prohibited from accessing women’s sexual abuse survivor support groups on account of their masculine appearance. They also claimed that a trans woman discriminated against because she was perceived to be a cis woman could file a sex discrimination lawsuit.

    Far from adding “clarity” to the law, Westminster seem to be intent on making it even more murky…

  10. This is the least important issue of our modern time and yet it gets the limelight as though it’s a genocide or the patriot act of Citizens United or a new unjustified war. 

    It’s just not that important. We only have a limited, and I mean extremely limited, amount of pull as voters without insane amounts of money. 

    Why is this where we’re pouring in our time and effort? Like why is this the hill to die on and not blasting innocent people in Gaza or Yemen or Iran?

    Why have I seen more headlines about trans bathrooms than AIPAC controlling the US government or laws that made anti semitism be defined as hating Israel?

  11. It seems like all trans women are allowed to use male restrooms, but some trans men (those that look too manly) are not allowed to use female restrooms. In the ruling, the court gave explicit exemption for the latter but not the former.

  12. Does the government know it can pass a law allowing “biological man and women to go into their toilet according to their gender without being motivated by prejudice and/or malice”. Simple fix. (Unless its more complicated than that).

    This is just run of the mill, completely standard UK legal process. This wasn’t fast tracked through the courts. This wasn’t given special legal protection. This is what trans rights groups want, procedurally, insofar as they are able to challege laws discriminating them. In this they very clearly did not get the result they wanted, but the process, ie the time, money and legal attention, is what they want. 

    It seems to me good actually, that the Scottish government pursued this to the Supreme Court. 

    I’m sorry to everyone upset about the outcome but how it was done and why it was done, are for the correct reasons.

  15. Or else what? Bathroom doors are just a custom, not a steadfast rule. My mom used to use the men’s room when there were long lines for the women’s. I didn’t realize at the time she was a hardened criminal.

I am some sympathy with the court ruling because I think there is a material distinction between trans women and cis women and needs to be taken into account in some situations but I am shocked at how this has swiftly been interpreted by the government as a prohibition against trans women using women’s facilities in all situations.

  17. As media myself, it sticks out to me that they were _very explicit_ about _othering_ trans people. Want equality? Go be in a third space that doesn’t actually exist outside our binary they are saying. It’s pure corporate style exclusion, which stabs you in the spleen with a smile and a survey, which is also a fast track to simply “choosing” to refuse service or care to trans people because “they don’t count” as people.

They are alienating their own voter base, massively dropping in polls, their voters are shifting to greens and lib dems, and this government is quickly becoming one of the most hated in history. The stupid argument that they need to become right wing to stop right wing from gaining power isn’t working either (not that it ever does) when you see how high Reform UK polls rn. Is Keir Starmer secretly a tory agent trying to ruin the party?

  19. Aside from the obvious problem of completely ignoring trans men, what about situations where there’s a massive queue for the women’s bathroom so women just nip into the men’s instead. Is that illegal now too?

  20. Is the “one self-contained cubicle that can be used by anyone” that they refer to, the disabled bathroom? Yes, it can be used by anyone, but it should be kept as free as possible so that it can be used by disabled people, who may need to use it urgently. Once again, disabled people aren’t considered in these discussions.

We keep being told, by people with terrible things to say about trans people, that trans people are fine but there are dangerous men who will take advantage of trans women’s access to women’s spaces so it’s important to exclude trans women. Yet these same people are jumping with delight that they have beaten the trans women and that trans women are the enemy. It really seems that the enemy to these people wasn’t the sex offenders but the trans women who were just going to the loo.

    I guess from their perspective it’s fortunate that this will result in a minority group who suffer sexual violence against them at a far higher rate than the general population into spaces where they are more likely to experience that violence.

  24. Forgive my ignorance, but is it actually against the law to use whatever toilet whenever? Like, if I, a cis male, go to the women’s toilet at a public toilet place or a restaurant in the UK, could someone report me, leading to me facing legal ramifications? And I don’t mean whether someone is likely to actually do that or whether the police would be bothered to follow up on it. I’m asking if even just in theory I am breaking the law.

  25. i met my closest friend who’s a trans woman in the women’s toilets. shocker i know but she’s a woman. she needs to pee. we struck up a friendly conversation and we have a lovely friendship over a few years now. it hurts my heart to see trans women treated not like human beings.
