Not sure you understand what the admin is trying to do. They’re trying to say being born here is NOT citizenship-granting. That is, that the federal government can **arbitrarily** pick and choose what people get to be citizens.
Did you hear about some of their early court arguments? They tried to cite a pre-Civil-war law denying citizenship to Native Americans as an argument for why we should end birthright citizenship for immigrants.
They tried denying Natives’ citizenship as a stepping stone argument.

Ironically the 14th amendment did NOT originally give Native Americans birthright citizenship, because they were considered to to NOT be “born or naturalized in the United States, **and subject to the jurisdiction thereof**” because Indian nations were considered sovereign protectorates.
