>Judges unanimously rejected an appeal by landowners Alexander and Diana Darwall who said people should not be able to camp without permission from landowners.

Fantastic news, now don’t bloody ruin it!
Scotland has amazing right to responsible access laws meaning wild camping is possible in loads of places, but the closest nice place to a major population centre, Loch Lomond, barely 30 minutes from Glasgow, was getting trashed by idiots and they had to roll back the laws limiting camping access to prevent permanent damage. Now wild camping is prohibited except in tiny areas which are permit controlled.
>The judgement centred on the interpretation of a Dartmoor by-law that states “the public shall have a right of access to the commons on foot and on horseback for the purpose of open-air recreation”.
you don’t get to buy property that comes with encumbrances and then ignore them.
Good, now is this is the end of the matter? Or can the landowner pull more legal shenanigans / appeals?
“The judgement centred on the interpretation of a Dartmoor by-law that states “the public shall have a right of access to the commons on foot and on horseback for the purpose of open-air recreation”.
It said references to open-air recreation were “open-ended and unqualified” and “naturally includes camping”.”
This goes to show that such things should be based on a clear law, as opposed to interpretations of judges which could just as easily have gone the other way. The way that landowners have taken the mick on open access areas for the last 20 years is pretty appalling.
Plus, these landowners sound like complete twats. So if they are crying then I can only conclude that its a good thing indeed.
A good ruling based on the common understanding of the words “open-air recreation”. Absolutely mad that it had to go all the way to the Supreme Court to rule on something so blindingly obvious.
I hope this cost Darwall a fucking fortune.
I know nothing of this bloke, but he sounds like a twat from a brief google
