League City man suing police who arrested him for not displaying handicap placard

Scott Shearer says the cop ordered him out of his car before pointing out that Sheer was parked in a handicap spot but didn’t have a placard. Sheer said he did have one. It just wasn’t hung up because it states you’re not supposed to drive with it on the mirror and he hadn’t got out of his car yet. The arresting officer asked to search Shear’s car. Sheer tells him he said no, but that he’d be happy to get the placard for the officer himself. He said no. Turn around. You’re under arrest. I was I was shocked. Records show he was booked into jail for failing to display a handicap placard. Sharer sent us this League City Police event report, which says the placard was found inside his car on the passenger seat. Eventually, the charges were dropped, but being a career criminal defense attorney, he says he felt something had to be done to stop an arrest like this happening to someone else. He was just untrained, uneducated, and overly aggressive. Now, he and attorney Randall Kalanin have filed a civil rights lawsuit against League City Police and the officers involved. They say League City police need to answer for why they arrested a man for what would typically lend someone else a ticket or a warning.

  1. Personality test need to be more strict an if the person fails at all or they are found to make reckless decisions or are quick to anger. They don't get to be a cop…

  4. UNTIL or UNLESS these incompetent public servants are held accountable, they have NO incentive to stop, after all they get a paid vacation & or a promotion & the tax payers have to foot the lawsuits, why should they care ?? All we do is talk talk talk & that's cheap…

  5. The lawsuit will be summarily dismissed under Atwater v. City of Lago Vista where SCOTUS held that a officer has vast discretion and they CAN if they so choose to arrest someone instead of writing a ticket. This was my area of law school studies….theyve filed a 42 USC 1983 but it wont move forward.

  6. If it was on the mirror ahead of time, he would have been charged with obstruction of vision. They ticket you for air fresheners, or anything hanging there. They do whatever they want. No shame, no accountability.

  7. He got off easy. There will be no repercussions and it would’ve been much worse if he had been black or a woman.
    Now that the Department of Justice’s Public Integrity Section, the office responsible for investigating police corruption allegations, is being reduced by the to a small handful of employees.state and local police have carte-blanch – they can now do whatever they want, whenever they want. For example, the case of the Johnson City, TN Police Department… this police department allowed the USAs most prolific rapist and pedophile to do continuous assaults on women and children because he paid off the police department with the money he made as a successful drug dealer – for years. We now know this – proof has been obtained – and now, thanks to Trump, there will be NO repercussions at all. NO ONE IS COVERING THIS – this s worth some journalism, don’t you think?
