The amount of care being given has nothing to do with the suit. It has to do with material misrepresentation. This headline is mis/disinformation

I think the appropriate remedy is for the shareholders to vote in a new board of directors, who could then steer UHC onto a new course.
It isn’t unreasonable for a management to exercise “damage control” in order to deal with a public relations disaster, which appears to be a component in the murder of their CEO.
Apparently, this damage control included “compassionate” case management, which is what is being sued on. There is certainly a penny wise/dollar foolish argument that can be developed here.
A penny wise solution would be to prohibit compassionate decisions. It could be dollar foolish because making the terms of the plans more draconian jeopardizes sales to future beneficiaries.
I don’t see a judicial straight-jacket as appropriate in these situations. This stuff belongs in BOD territory.
Well…today in America operating as a corporation provides some powerful legal shields and incentives that in practice, can result in harm to many people, sometimes even loss of life, but rarely holds individuals directly accountable.
The lesson here folks is if you harm someone as a private individual, you can go to prison. But as a corporate executive, if your company’s policy leads to harm it’s a “business issue.”
So if you’re planning to do some harm… be like Black Rock…Incorporate…🤪
Just do universal healthcare like the rest of the world
