Hello, I need help with my work visa. Today I received this response from the embassy. Is there an additional deadline or is the visa completely canceled?

  1. It depends on wether your employer complied with their request and sent them the documents. If your employer did not do that, then most likely your application got rejected. Maybe your employer can contact the embassy and explain them why they need more time to fill in the documents or if there was an issue or smth. I would assume you will also get informed about a rejected application either way.

  2. Talk to the employer, point them to the eMail they should have received from the embassy and insist the pertinent documents to be sent immediately.

  3. The response is giving you 14 days from the time they sent you this e-mail to get them the documents they want.

    If they sent the mail today, you have until the 16th of June.

    The timeline is implied. They sent your employee a request on the 19.05.2025 and are saying that if he doesn’t reply within 14 days (from the time of THIS mail) they will cancel the process.

    Their use of language isn’t very precise though: The use of tenses doesn’t make sense, if they already cancelled the application but they’re also not specifying whether the 14 days start from this mail or their contact to your would-be-employer. You can always call them to verify.

    EDIT: For all of you, OP was sent the mail today (according to OP). If the deadline had passed the embassy would not have used the conjunctive case. The use of the subjunctive strongly implies an additional 2 weeks to send the documents.

  4. § 39 Abs. 4 AufenthG:

    >(4) Für die Erteilung der Zustimmung oder Arbeitserlaubnis hat der Arbeitgeber der Bundesagentur für Arbeit Auskünfte in Bezug auf das Beschäftigungsverhältnis, insbesondere zum Arbeitsentgelt, zu den Arbeitszeiten und sonstigen Arbeitsbedingungen, zu der Sozialversicherungspflicht und zum Erfordernis einer Berufsausübungserlaubnis, zu erteilen. Auf Aufforderung durch die Bundesagentur für Arbeit hat ein Arbeitgeber, der einen Ausländer beschäftigt oder beschäftigt hat, eine Auskunft nach Satz 1 **innerhalb eines Monats** zu erteilen.

    as per law your employer has 4 weeks to answer (technically 30 days but yes…)

    The mail you got is just to inform you that you should take action and get your employer to send the documents. **your visa has not been denied yet!** but it will be denied if they don’t get the documents within the next 2 weeks.
