So I’m american living in germany, I was involved in a accident with a moped. Polizei said I was at fault when I believe I wasn’t. I’m seeking legal action but want your guy’s opinion. So i was driving and and came to a complete stop waiting to make a left turn. It’s a busy intersection so i was stuck for a while. A car from the other direction realized I was there for a while and also turning left( their pov a right turn) basically going where i was going. They signaled at me by slowing down flashing their lights and waving at me. I waived and proceeded slowly. From behind the car that’s letting me turn comes a moped. mind you this is a one lane road. he illegally passed and ended up hitting me mid turn. also once i realized i had time to come to another complete stop and watch him hit me. Polizei said since i have to yield to that side of the road i’m at fault. My reasoning is if he was in a car instead of a moped he would’ve ended up on the other side of the road and collided head on but since he’s on a moped he was able to slide by thinking he was slick. What do you guys think? To add to this there was a solid line indicating you cannot pass. i will try and add a picture as well.

Says who? You? The police?
As you was hit during your turn on the other side of the road (so I understand you), you are at least partially at fault.
