The US Census Bureau and a worker hired under a program for individuals with disabilities have agreed to settle and dismiss claims that he was fired unlawfully after being denied accommodations for a range of conditions.

The case was dismissed without prejudice Monday, according to an order signed by Magistrate Judge Stewart D. Aaron of the US District Court for the Southern District of New York. Plaintiff Trent Berger’s attorney also filed a notice the same day announcing that the parties had settled, “subject to a mutually acceptable written settlement agreement.”
