Hello everyone! Just a quick question, my lovely wife has just got this in the post this morning. Clearly been going on awhile. She is stressed to the holt! So.. are we banjaxed or just ignore and hope for the best lolz

So long as you have never identified the driver (best if you never contact them in any way, certainly don’t use their sham ‘appeals’ process), then there’s fuck all they can do but waste their time and money – and who are you to argue – sending you a succession of increasingly hysterical but utterly toothless letters – let them.

    They’ll get bored after a year or two and move on to try and intimidate someone else into thinking they have to pay.

    These clowns have no more legal jurisdiction over you than Iceland (the shop, not the country).

    The difference is in England they can go after the registered keeper, regardless of who was driving. Can’t do that here, so instead they rely on you to shop yourself by contacting them or appealing.
    Do neither.

  16. Standard fear tactics from an *English debt collector (GCTT)* who are acting on behalf of Smart Parking here. You’re in Northern Ireland and **bailiffs don’t exist here**, and these companies rely on people not knowing that.

    They can’t enforce anything without first taking you to court in NI, winning the case, and registering the debt with the Enforcement of Judgments Office (*EJO*). That’s a long and costly process, especially for a something as trivial as private parking charge, most won’t bother.

    All this letter is designed to do is pressure you into paying before they even consider “*further action*”. Unless you get actual court papers from an NI court, there’s no legal obligation on you to respond to this. They have no power to send anyone to your door or to affect your credit.

    My advice, just ignore this, do not respond or engage at all, it’s £170, nowhere near enough for them to hassle themselves escalating. Throw it in the bin or wipe your arse with it. That’s all it’s good for.

  20. In N.I the company must identify who the driver is and levy the charge against the driver NOT the registered keeper of the vehicle. Do not engage in correspondence or acknowledge.

  23. According to companies house there are 553 companies registered at that address. Also, their company number on their website points to ZZPS limited not GCTT, which is a pretty clear indicator that this is just a shell. They likely don’t have any physical presence at that address and just use it for companies house through an accountancy or something.

    These people are just Smart Parking Ltd trying to bully and confuse you. I receive d a similar letter about 6 years ago, back then they were less smart about it and their fake legal firm had the same listed address as their England HQ. I guess that was too easy for people to figure out.

    Also, the rules about enforcement are different here. In England they can prosecute the owner of the car even if they were not driving, but here they need to prove that you were the one driving, unless they have very clear photo/ video evidence of your face driving the car at the time of the infraction they literally can’t do anything. And even if they had that it’s still hard to prove in small claims court. Plus it’s expensive for them because they have to have someone over here go to court for them in person to prosecute the case, which they know they would likely lose. Which is why they never do it.

    This is why he letters will have increasingly unhinged numbers for the fine. Ours got up to £700 before they realised I was wiping my arse with them and stopped sending them.

    These people are running a racket, they make almost as much money from their ‘fines’ as they do from paid parking. They are in no way proportionate to the revenue lost, it’s one of the last legal scams. Honestly if their company just suddenly ceased to exist the world would be a better place.

  25. Seems the majority are right, do not engage, ignore & bin. I think it’s a good idea to avoid any business that employs these menaces to manage their car park, and an email to the tenants of this retail park might help them decide to hire a firm that can do a better job. Perhaps one that doesn’t have the people skills of Atila the Hun would be good….

  26. I got 7 of those letters within 2 years. Stopped about 6 months ago. Just kept putting not at this address on it and putting it back in the post box 😆

  28. Years ago I moved to a flat where the previous tenant owed 50 quid on gas bill or something.

    We never paid. Kept getting red letters, then a couple of solicitor letters… Then back to ordinary bill, then red, then solicitor… And continue for 2 years.

  31. Are you good at basketball? Roll that shite up in a ball and get some practice in. Fuckin get in the bin. Parking enforcement outside of the DVA or Council has no legal standing in NI and they cannot enact CCJs or fines against you. Their English bollocks has no power here.

  32. They throw the word solicitors in there to try and scare you. Don’t know of any solicitors here who would actually take you to court over a private parking company charge 😂, it’d have to be the company themselves.
