Hey guys I posted about this a few days ago, saying “ I have received this letter from my flat company after almost 4 months of moving out, this says Betriebskostenabrechnung vom 01.01.2024 – 31.12.2024 but I only moved into the flat in November 2024, and I moved out end of March 2025, l've been waiting for them to send back the Kaution which they sent me a letter about it and they have already took around 200€ from my Kaution that they r yet to give back to me, and now this letter saying they want me to pay another 250€??? Can someone please explain why am I being charged twice for this?”
I have emailed the flat company and this is the answer I got.
First two pictures I posted before regarding the Nebenkosten, third picture is them taking 150€ from my Kaution and now they are saying in the 4th picture which is the email I got from them that they will keep the 150€ to pay the difference in Neben kosten? If so then why did they not count that in the first letter? Now do I still pay the 250? I don’t want to pay the 250 and then they send me a letter about deducting 150 that belong to the Kaution from the 250 I paid, I’d end up waiting on them to pay me that back? This makes no sense.

You owe 250 on the move in to end of December period.
They agree to fully hand your deposit back minus 150 for the Jan 1 to move out period.
You will receive the Nebenkostenabrechnung for that time somewhere beginning of next year. The 150 is held by the landlord to insure him for the case that the prepay wasn’t sufficient to cover energy usage during that time. This is legal and common. If there is a surplus at the end, you will receive it with Nebenkostenabrechnung 2025.
You are not being double charged. You are being charged for 2 consecutive periods.
Pay the 250, send them your bank information to receive your deposit back.
