Long story short, I came to Switzerland few months ago and I moved into an apartment which is the last on the first floor (so, the one at the most right side of building) and unfortunately I live now right next to another building which has a restaurant below.
So, there are many restaurant in this street but somehow this is the only one which has a deck outside for clients. Not sure how…
The problem here is that they decided now to increase the deck by 2x the length of the previous one and now the end of the deck ends right where my window starts. So now people sit there and are basically 2/3 meters from my window!
However the issue start for the following reasons:
1- I can’t have my blinders open otherwise I have 0 privacy.
2- Clients bring their own speakers and put music loudly.
3 – Clients smoke tabaco and weed constantly.
4 – My windows have 2 inlets which can’t be closed due to ventilation laws which means a lot of the smokers fumes come into my apartment and I become a passive smoker 24/7.
5 – Somehow people stay there usually until 00:30/01:00h. Latest I have noticed is 02:00h
6 – This happens almost everyday, working and non working days.
7 – I can’t sleep because when I am in bed there is no noise inside the apartment so every noise outside is more easily heard. Even though the acoustic isolation is quite good.
So, I am starting to get very exhausted with this. I feel no privacy, I hate being hit with smoke inside my own space, and I want to sleep because I work and I am not sleeping as I wished because of these people.
My main question is, how do you guys would deal with a situation like this?
I wrote to my property manager but I doubt that they will do anything against that.
On the other side I also have little to no hope of going to the city administration and complain. I think they will do absolutely nothing.
There is a place 1km from here full of drunk and drugged people and police does nothing to stop that…
So my hopes are going into the direction of actually having to change to another place.
However I feel that it is unfair since I don’t think I am in the wrong here…

Blast DJ Bobo on repeat until 10 PM, call police at 22:05
Keep a log. Report to the landlord and remind daily as long nothing happens. Start the process of paying a part of the rent to a blocked account. After 22:00 call the police, daily if needed.

So: You move into an apartment next to a restaurant and complain that the restaurant has (probably legally) enlarged its outdoor area ? You can either deal with it, talk to the restaurant owner or find a new apartment.
Honestly, you need to move. The police is unsympathetic about noise complaints by foreigners in my experience, especially from students and restaurants.
Wish the country would ban smoking in restaurants and patios. Can’t eat on patios without having the smoke assault your taste buds.
You can expect a rent reduction from the moment you inform the landlord about the issues. Some court rulings:

This sounds weird. What are these ventilation laws you’re talking about? All my windows can be fully closed and I’d be very upset if it wasn’t the case.
