The National Energy Regulatory Authority (ANRE) has approved the Order on the Implementing Rules for the exemption from payment of regulated tariffs for electricity stored and subsequently fed back into the grid.
The main purpose of this regulation is to eliminate double taxation on stored energy, a significant obstacle to the development of storage technologies, which are essential for balancing the energy system and integrating production from renewable sources.
“We cannot build a balanced and resilient energy system with rules that penalize innovation. This regulation sends a clear signal to investors: Romania supports energy storage, not only as a technological option, but as a pillar of the energy transition,” ANRE President George Niculescu said.
“This is a decision that corrects an injustice and sets the stage for the real development of storage capacity – an essential piece in the architecture of the energy future. I see this step as part of a journey that started during my mandate at the Ministry of Energy, when I supported the adaptation of legislation to technological realities and innovations. Now, at ANRE, we are turning these ideas into concrete policies. Despite the background noise, we focus on what matters: providing the market with clear, modern and efficient rules. Romania needs regulation that supports investment, not inhibits it. Regulation that allows innovation to become infrastructure. This is what we intend to do, regulation by regulation,” ANRE President added.
The regulation provides the following:
Exemption from the payment of transmission (withdrawal component), distribution and system service tariffs for electricity stored and fed back into the grid Exemption from the payment of green certificates Introducing clear obligations for grid operators to report stored energy quantities Implementing a uniform procedure, applicable to both concessionaire and non-concessionaire operators.
The exemption applies strictly to energy stored and fed back into the grid. For the storage unit’s own consumption, including technological losses, the grid tariffs remain applicable.
The regulation is aligned with European best practices and ACER recommendations, which encourage differentiated tariff treatment and incentives for grid flexibility. Romania therefore joins the group of countries actively supporting storage investments through modern pricing policies. The ANRE order supplements the amendments enacted by GEO No. 134/2024 and contributes to the creation of a coherent and predictable legislative framework for the development of the energy sector.
