  1. I get that this on the books in NM, but hell, it is hard to get a DUI here if you are in a car. And if you do it is misdemeanor until you have at least three. We joke that it is a requirement to get hired on at the county.

  4. Very surprised you can’t get a DUI on a bike in NY/NJ. You’d think a drunk cyclist poses the highest risk in the NYC metro of all places nationally.

  5. In Canada you can’t get a DUI on a bike.

    You *can* get a DUI on an ebike or other assisted transportation device. Having the motor is key.

    You can get public intoxication and other assorted charges because of you riding a bike drunk, but the actual act of riding the bike isn’t the issue.

    That said, *any* form of boating while drunk is a crime since being in control of a vessel while intoxicated is the crime. Not a ‘motor vessel.’

    Because of that it includes canoes or kayaks or even an inflatable tube floating down the river. It’s also illegal to have open containers in those vessels.

  7. Some of those states actually have generic language and it’s not specific to bikes but any vehicle you are in control of. 

    I remember someone riding a horse down a freeway while drunk a few years back got a DUI in CA.

  12. Yeah here in WI I still think they will nail you with public intoxication which is stupid as your screwed if you drive and screwed if you do the right thing and take other non motorized way.

  13. I was riding a two-wheel bicycle, came to a light, and fell over. Cop pulls alongside and asks, “Have you been drinking?” No, sir, I have Parkinson’s. The next question was “Does the care home know where you are?”

  16. You can get a DUI on a bike on Mackinac Island in Michigan. It happens all the time.

  17. Can get or will get are two very different things. You are a vehicle and must follow vehicular law… but all the folk riding around having a good time and not being assholes aren’t getting stopped for breathalyzer checks.

  21. I understand someone drunk on a bicycle can hurt themselves very badly, but it seems a bit unreasonable to hit someone with a life altering criminal charge as if they were driving drunk putting everyone at risk versus riding a bicycle and maybe getting scrapes or a head injury.

  25. I’m not sure how many other states do this, but Ohio has an extra dumb gotcha, you can lose your drivers license from getting a DUI from biking. Extra, extra dumb – you can lose your drivers license for boating while drunk, but they don’t take your boating license.

  27. So it looks like the only way you can bike from the Atlantic coast to Pacific while drunk the entire time is to start in Virginia and end in Washington. If anyone wants to do that.

  29. So in a “data is beautiful” sense, these colors are not good. When you’re posing a question, green would presumably be yes, red no. Also, red/green color blindness is very common, so you’d at least want to change the luminance so they don’t match (lighter green, darker red, or some such)

When I was in HI (Military) I once stayed in Honolulu for a week as part of a work conference thing and I thought it would be a good idea to bring my bike to avoid a potential DUI after a night out drinking. Well I was riding back to the hotel one night on the sidewalk and a cop stops me and asks why I’m riding on the sidewalk. I told him it was because I had been drinking and didn’t want to cause an accident in the road, and that’s when he informed me that you can get a DUI in HI on a bike. He was super chill and told me if I just walked the bike back he’d let me off with a warning. At the time I didn’t realize how big a bullet I just dodged.
