Hey all,
I am currently moving out of the apartment and I am doing the handover of the place.
The landlord was there today and listed some problems in the Übergabeprotokoll which I am not sure that they are valid.
The apartment was perfectly clean but he said he will need to hire a cleaning company because of the oven and the sink faucets, photos below of how they are.
Also the Übergabeprotokoll stated some marks on the floor and walls plus a lack of pressure in the water faucets.
The thing is that the Übergabeprotokoll states that I am responsible to pay for all the repair and costs of everything written there.
Is that usual? Isnt some of it wear and tear?

Not everything listed sounds fair, honestly. Normal wear and tear like small wall marks or slight water pressure issues usually aren’t your responsibility. If the oven and faucets are reasonably clean, charging for a cleaning company seems excessive. It’s not unusual for landlords to try this, but you don’t have to sign anything you disagree with. You can contest it, especially if you have photos or proof of the condition.
how are you responsible for the water pressure? wtf?
Don’t pay anything, you always have the right to “repair” the issues yourself before a landlord can hire a third party and bill you in.
Neither the oven nor the sink are valid issues here though, if the landlord wants them more clean it’s his problem.
To be honest, the oven doesn’t look very good, the faucet looks okay. What is normal wear and tear and what isn’t a clear cut issue, we’d need to see more to judge that. In any case, you have to pay for everything that isn’t normal wear and tear, the landlord is right there.
I hope you’ve got a lot of evidence, and I would suggest going to a Mieterschutzverein and discuss your options with them.
What does it say in the Schönheitsreparaturen?
Well, that faucet is not perfectly clean. So, I am not sure I understand what you are asking.
Marks on the floor and such, well, are there any?
You cannot be responsible for the water pressure. (How?)
He’s trying to rip you off. Either get a Lawyer or go to there Mieterschutzbund or Mieterschutzverein.
Man if a tenant in the US left an apartment like this they would probably pay the tenant to come back.
When we moved in our flat, the toilet was downright DISGUSTING. It took us 40 minutes to scrub all of the… Whatever the hell it was.
I’m sure that the landlord company billed the previous tenants for some non-existing cleaning company though.
Ye those things don’t look clean, your landlord is right
If you remove the small filter under your tap water,, you might find some small sand that’s blocking your water pressure
Been there, done that — so to say. Unfortunately it happens quite often that landlords try to earn some extra bucks and get their appartments renovated on the former tenant’s expenses. For example, one of my former Landlords tried to get a complete new, expensive bathroom door on my expenses because there was a minor scratch in it. Luckily I had photographs that proved the scratch was already there when I moved in. So always make sure to take A LOT of pictures when you move into a new appartment. And consult a lawyer who’s specialized to such cases and let him check your landlord’s requests. DO NOT sign ANYTHING before that has happened.
