Giovanna Martinez, detained by ICE in traffic stop, faces dire situation, family says

The family and friends of a Birmingham woman are pleading with the community to help them keep her in Alabama after she was detained this week during a traffic stop.

“On the morning of Tuesday August 5th, Giovanna [Martinez] was driving to work when a Leeds officer pulled her over for going 1 mile over the speed limit,” reads a GoFundMe set up by her brother Dilan Hernandez to cover Martinez’s legal expenses.

“What should have been a regular traffic stop, turned into something much worse as an ICE agent arrived closely thereafter. In less than an hour she was processed and taken into ICE custody.”

Leeds police on Thursday issued a statement disputing that account.

Chief Paul Irwin said the traffic stop was made on Tuesday at about 7:44 a.m. on Interstate 20 when an unmarked Leeds vehicle was passed by a Honda sedan “at a high rate of speed of over 80 mph.

“The vehicle came within feet of striking other vehicles and erratically changed lanes. A marked unit with the Leeds Police Department stopped the vehicle,” Irwin’s statement continued.

“The driver did not have a driver’s license, but instead identified herself with a Mexico issued (identification) card. Pursuant to our policy, Detectives contacted our federal partners, who informed Detectives that the female was in the United States of America illegally.

“Our federal partners responded to the scene and took custody of the driver. This vehicle was stopped because she posed a danger to the public by driving in a reckless manner.”

Irwin said it was “unfortunate that the driver had not taken the steps necessary to remain in our country legally.”

“There are many people that I know and have friendships with who know this person and we wish her the best as she returns to her country,” Irwin said.

After she was handed over to ICE, Hernandez says that his sister was moved to Pickens County Jail where she currently awaits a decision.

“The situation is dire as ICE has been moving fast and plan to move her to Louisiana by the end of the week,” he continues.

According to Hernandez, Martinez had her own LLC and was working with HICA, an immigration advocacy organization based in Birmingham.

In a release Thursday, HICA wrote that Martinez is a “valued member of the ¡HICA! community.”

“As an organization, we are proud to work with her and her business, Juntos Coaching and Consulting, to empower youth across Alabama,” the release says.

“Giovanna is not only a trusted community partner, she is a role model,” wrote HICA CEO Dr. Carlos E. Alemán.

“She brings purpose and heart to everything she does. Her contributions have touched families and young people throughout Alabama, and her detention is a painful loss for the entire community.”

According to the release, HICA has been working with Martinez’s family “to support her in every possible way,” since she was detained.

“The first 48 hours were focused on helping them navigate immediate legal and emotional challenges, and on discreetly reaching out to state representatives and key decision-makers to advocate for her release,” the release reads.

“We want to be clear: ¡HICA! is not stepping away from this situation. This is not about us — it’s about Giovanna’s safety, her dignity, and the well-being of her family. “

Martinez recently earned both her bachelor’s and master’s degrees in social work from Jacksonville State University.

Much of her work focused on helping immigrant students in the metro area plan their next steps after high school.

She ran a program called “Escalera,” where she stressed the importance of a degree and helped students navigate college and trade school applications.

“I try to be a support to the students,” she told AL.com earlier this summer.

“Giovanna’s arrest has caused a significant impact within our community of educators and advocates in Alabama,” Estela Tirado, a fellow educator in Martinez’s group, wrote in an email to AL.com.

“This week, our kids go back to school, and it’s hard for our families and educators to know that someone who is a champion for them is in these circumstances; it’s just heartbreaking and discouraging.”

Friends, family, and community members who knew Martinez have flocked to a Facebook page set up to bring attention to her case.

“Giovanna has always been a source of hope, resilience, and kindness,” the page reads.

“Let’s return that love by standing with her now. She is not alone.”

Emily Barfield, who attended JSU with Martinez, has also authored a petition demanding her release.

“‘Why didn’t she just go get citizenship?’ you might ask,” Barfield wrote in a post to Facebook.

“The truth is: it’s not that simple. Her family tried and have been scammed multiple times in the process. Even so, she’s had documentation as long as I’ve known her showing she was working towards citizenship. That’s the only way she was able to attend JSU.”

The petition has received over 4,700 signatures as of Aug. 7.

HICA echoed the calls for Martinez’s freedom in their release Thursday.

“We urge immigration authorities to consider her longstanding contributions and act with humanity and fairness,” it reads.

“Giovanna’s voice is vital, and her presence is needed in the communities she so selflessly serves.”

Over the last two days, Hernandez said their family has been able to add money to Martinez’s account at the jail, which has allowed her to make brief phone calls.

“She’s staying strong for my parents,” Hernandez told AL.com Thursday.

“The conditions aren’t horrible, but she wants people to be aware of how unlawfully people are being brought there.”

“She has seen many young women with kids being taken there while getting separated from family with no way to contact them,” he added.

Martinez is the latest local detainment in President Donald Trump’s immigration crackdown, which is currently striving to arrest 3,000 people daily, according to previous comments from White House Deputy Chief of Staff Stephen Miller.

“Giovanna Hernandez Martinez was tailgating a law enforcement vehicle, passed them erratically at 80 MPH, and cut them off,” U.S. Department of Homeland Security spokesperson Tricia McLaughlin told Reuters.

“Upon witnessing this reckless driving, ICE and local police initiated a traffic stop and discovered she was an illegal alien from Mexico. Unlike the Biden administration, we are not going to ignore the law.”

Trump claims he has ramped up deportations in the name of public safety, but Martinez’s family, and many others like them, say this has gone far beyond that.

“Gio has no criminal record,” Barfield writes in her petition.

“She has spent years working toward lawful permanent residency but, like many others, has faced systemic barriers and even been scammed during the process. Her detainment is not only legally questionable — it is morally wrong.”

“This is personal for us,” Barfield continues.

“Giovanna is not just a name. She is our friend, colleague, mentor, and inspiration. She represents everything we want in a citizen: integrity, compassion, hard work, and a deep love for her community.”

“Deporting her would be a grave injustice not just to her, but to all of us who believe in fairness, opportunity, and human dignity,” she writes.

Two Iranian men, Alireza Doroudi and Ribvar Karimi, were detained by ICE earlier this year on claims of being in the country illegally and being a “violent extremist,” respectively.

After over two months in detention, Doroudi requested voluntary deportation in May and returned to Iran over the summer.

Prior to allegedly being advised by the FBI not to speak to the media, Karimi’s wife, Morgan, said they were still fighting to keep him in the country.
