I recently just learned of this and wish I knew it sooner cause it would’ve saved a lot more anxiety. bet i’m not the only one on here whose (American) tourist visa expired while waiting for my permit and has worried about being deported since it is impossible to get a Notfalltermin for a Fiktionsbescheinigung, but according to these laws I found on site, we are legally allowed to stay until a decision has been made [Section 81(3) of the Residency Act] and the Ausländerbehörde has 3 months from your application date to process your visa and get back to you and if they have no valid reason (you don’t have missing documents or anything) you can attempt to sue them (with a lawyer of course) [§ 75 VwGO]

just couldn’t trust nobody anymore; people saying i‘d be fine but other people saying i would get deported, i couldn’t trust anyone except a legal reliable source that proves and states my current situation. hope this helps someone out too.
This is not America, we don’t just deport people here. You’ll definitely be fine
