I am paying 200e nebenkosten every month, which is decided by my contract with my landlord. So my question is do I need to pay the difference if I had spent more on heating and warmwasser even if I am paying this price per month in Nebenkosten. I have found this online and I don’t understand it perfectly.

Vermieter können die Nebenkostenabrechnung mit der sogenannten **Nebenkostenpauschale** umgehen. Darunter versteht man laut § 556 Abs. 2 S. 1 BGB einen festen Betrag, den Vermieter gemeinsam mit der Miete erheben können. [Hausmietvertrag](https://www.homeday.de/de/musterdokumente/hausmietvertrag/) zu vereinbaren und hat auch ohne Nebenkostenabrechnung Gültigkeit. Hat der Mieter zu viel gezahlt, muss der Vermieter ihm nichts zurückzahlen. Gleichzeitig sind Rückforderungen an den Mieter bei zu gering bezahlten Nebenkosten nicht möglich.

Also when I signed the contract it was from 01.12.2019 and I had to pay my landlord for only one month 211e because he told me I spent 411e and only paid 200e neben kosten. How is that possible in only one month and the weird thing is we didn’t even live there that month we were just moving in things?

  1. Does your contract say anything about a nebenkostenpauschale? If yes you usually don‘t have to pay the difference (but also don‘t get money back if you didn‘t use 200€/mo).

This really depends on how your contract is worded – A Nebenkostenpauschale is usually only set up in places where it is technically not possible to measure individual usage of effects that constitute Nebenkosten (for example if there is only one central water meter for multiple parties) – most contracts just stipulate that the amount you pay is an “Abschlag” (pre-payment) that will then be used to pay down the actual bill after measurements have been taken, meaning you get money back if you overpaid or pay up the rest if you underpaid.

  3. “Nebenkosten” usually is a pre-payment and you will get a detailed calculation (“Nebenkostenabrechnung”) once a year. If you used more, you have to pay the difference. If you used less, you will get money back.

    That is what your landlord did for 2019. But I highly doubt that you can use > 400 € in one month without even living there. You should check the “Nebenkostenabrechnung” in detail and/or contact your local Mieterschutzverein (Tenant Protection Association). You have 12 months to do so (from the day you received the invoice).
