WASHINGTON (Gray DC) – Less than a week after a federal appeals court ruled President Donald Trump exceeded his authority unilaterally imposing tariffs on America’s trading partners, he’s now asking the U.S. Supreme Court to quickly overturn that decision.
Trump used the International Emergency Economic Powers Act to impose steep tariffs on America’s trading partners after declaring America’s trade deficit with other countries is a national emergency.
On Aug. 29, the U.S. Court of Appeals for the Federal Circuit ruled in a 7-4 decision tariffs are taxes – and a “core Congressional power,” not a power the president can unilaterally impose.
“We’re in a much better position. We have trillions of dollars coming into our country. If we didn’t have tariffs, we would be a very poor nation and we would be taken advantage of by every other nation in the world, friend and foe. We’re not going to let that happen. And we have a very, very big case in the Supreme Court,” Trump said Wednesday.
The president is predicting a victory at the conservative majority Supreme Court, but he acknowledge Tuesday that should he lose, he has no Plan B, and would be deprived of a central plank of his administration’s trade policy.
