
I come from the Balkans. I paid an agency to do my diploma annerkenung and find me an employer in Germany, which they did. But now they also want me to sign this, which sounds pretty absurd to me. Could they really make me pay 5000€ if I kündige at some point during my employment?

I don’t see an issue with them offering contracts with such conditions. If you agreed to such a contract I cannot say.

Wouldnt do it. Sounds really bad. If possible and if you need it try to look in your local job offers, but wouldnt do it that way. This condition is crazy bad
I don’t think it’s a legal clause and would be not enforceable. Nonetheless, don’t sign this. It’s definitely very dodgy business practice

Whether it is legally enforceable – either before or after it has gone through courts – I don’t know.
Just don’t go with an agency trying to put you into indentured servitude with so badly written contract clauses.
The way its worded is super bad. If by any means you fail you are supposed to pay. If that would be legally worded it would include a passus about selbstverschuldet.

Yes i think these agencies give you a contract before they start looking for employers, where it says that if they find a job for you, you have to pay a % of your first payment. Could be different now and they expect you to pay each month. Check the contract again. If you dont sign, they dont search for jobs. I would then think you have already signed.

This does look like a scam. Although I don’t know about laws in Balkans.
However, there a valid contracts in Germany which require you to pay back money in case they provide some sort of education which is needed for you to start the job.
I have seen that kind of contracts in different types of firms, the firm offers to pay for your education or qualification but they require you to sign a contract which states that if you leave the firm before a certain amount of time – 2 years most of the time – you have to pay a percentage of the education cost back. Based on how many months you left before the end of the contract. If you sign for 24 months and leave 10 months afterwards you have to pay education cost divided by 24 multiplied by 14.
There is a specific reason they do it that way and it’s most likely based on court rulings.

That doesn’t sound logical. If you sign a work contract with a client of the firm, that work contract will have its own terms. Normally people are allowed to terminate their work contracts if not satisfied. Firms can fire you, but you can also quit. You just have to follow the procedure, like 2 weeks notice, a written and signed letter of resignation, etc. We are not slaves, we can quit a job! It’s not the first time I see something like this. My ex had signed something like that, a firm had decided to provide free housing and free german lessons for him for 6 months with a small allowance and then he would have to work for them for 2 years, or pay some thousands. He worked for them for a month, then quit because he didn’t like the job. Nothing happened. Absolutely nothing. No lawyers were involved from the firm’s side.
