An east Belfast man accused of subjecting a delivery driver to racist abuse has been remanded in custody.
Neil Pinkerton today appeared before Belfast Magistrates’ Court after being charged with nine offences alleged to have been committed on September 6 this year.

The 37-year-old, from Clandeboye Street, is facing three counts of common assault, two counts of using disorderly behaviour at Connswater Retail Park and at a McDonald’s fast-food outlet, trying to damage a car, harassment, possessing Class B cannabis and inciting hatred.

Refusing to grant bail, District Judge Steven Keown told the unemployed defendant: “People who harbour the views that are alleged against you are an absolute plague.”

The judge said that, as such, the risk of further offending “is unmanageable”, so he was refusing bail due to the risk.

Giving evidence to the court, a police officer said she believed she could connect Pinkerton to each of the offences, adding that the PSNI was objecting to bail.

The officer outlined how the charges arise from an incident at a McDonald’s outlet on Saturday afternoon, when Pinkerton allegedly threatened a delivery driver “due to the driver’s race”.

The officer outlined that while the complainant was outside McDonald’s waiting for his next delivery, he was approached by a male who was behaving in an aggressive manner, demanding to know “what he was doing there”.

The delivery driver, realising he was being recorded, asked Pinkerton to stop filming. But, according to the police case, a second man then approached and, due to the men’s actions, the delivery driver was “fearful of assault”.

The complainant sought sanctuary in his car and locked the door “for his own safety”. However, Pinkerton “continued shouting and swearing and jumping on the bonnet” of the vehicle.

Later that day, the alleged victim “became aware of a video circulating on TikTok”, adding to his concerns about his identity and car registration being known.

When officers searched Pinkerton’s home, they seized two mobile phones and a small quantity of cannabis.

The court heard that, in line with McDonald’s anti-social behaviour policy, the security officers at the door of the fast-food outlet had spoken to two girls before letting them in.

Pinkerton, however, “became angry” at the door staff, telling them that “they’re not allowed to speak to females from Northern Ireland”.

“They took this to be racially motivated,” said the officer, adding that police were objecting to Pinkerton being freed as “there is a high risk of further offending”.

The officer claimed there had been a previous incident where Pinkerton was allegedly involved in a racially motivated incident involving a young family and also that police are investigating an incident where the defendant allegedly “assaulted a homeless person and threw his sleeping bag into the Lagan River”.

The officer said that, along with a risk of witness interference, Pinkerton’s behaviour “appears to be escalating”.

Under cross-examination from defence counsel Turlough Madden, the police officer conceded that Pinkerton has no previous convictions for racially motivated crimes and that Pinkerton has not breached bail at any stage before.

Submitting that the incident “is a verbal argument, at its height”, Mr Madden acknowledged that Pinkerton has “deep and anxious feelings about the political situation in the world”.

He contended that given the lack of bail breaches and lack of racially motivated convictions, Pinkerton is “an ideal candidate” for bail.

Revealing that full-time single-parent Pinkerton is not employed but is claiming benefits, the barrister told the court the defendant “struggles with his mental health”.

“He is terrified at the prospect of being remanded into custody,” said Mr Madden, adding that Pinkerton “denies that the argument was racially motivated and he denies that he was hostile”.

Citing the risk of further offending, Judge Keown refused bail and remanded Pinkerton into custody to appear again on October 6.

As Pinkerton was led to the cells, a number of men in the public gallery waved and pointed their fingers upwards.
