    The Supreme Court on Tuesday agreed to fast-track a case testing President Donald Trump’s authority to impose sweeping tariffs under federal law. The justices scheduled arguments for November, an unusually quick timetable by the court’s standards.

    Small businesses and states challenging the tariffs say Trump illegally invoked emergency powers to levy import taxes on goods from nearly every country, pushing them to the brink of collapse. Lower courts have largely sided with the challengers but left most of the tariffs in place while the case proceeds.

  7. We all know how it will go… SCOTUS will give Turd another win in his consolidation of power.

    Congress has the constitutional authority to set tariffs, but it has delegated some of this power to the President through legislation like Section 232 and Section 301 of trade acts. These laws allow the President to impose tariffs under specific conditions, such as those related to national security or to address unfair trade practices, but the delegation of power is limited and subject to constitutional checks. 

  8. It’s confusing, but the profiteering outcome is that they strike the tariffs down and allow investment companies that have bought refund rights to make boatloads of money. Oh and prices won’t come down, so more profit for large importers.

  12. We are so far past the idea of “calling balls and strikes” with SCOTUS. I mean, we are really deep into, “SCOTUS is the official judicial branch of the Republican party” type of ratfuckery. These are literally unelected political actors that wield a majority power capable of rivaling both the Congress and President of the United States.

    I would sooner vote to abolish SCOTUS than reform it. Also, just a reminder that SCOTUS is the reason our politics are so fucked up, it is a snake eating its own tail, see Citizens United v. Federal Election Commission, 558 U.S. 310 (2010).

  27. This is interesting. They are his dogs, to be sure. But they have to choose between doing what he orders and saving him from himself. If the tariffs stay in place, the economy will be back in full recession by the midterms. They could choose to save him from himself.

    and don’t even bother to use the Constitution to back up their treason.

    A couple of RVs and some fancy trips on a leased jet and suddenly they’re all simping for a fat turd in a blue suit. If they were smart and not so cowardly, they would have taken the bribes and ruled against him every step of the way anyway. It’s not like Trump can sue them. All that power and they’re willing to piss it all away for a few consolation prizes. Mind-boggling stupidity in those robes.

  35. Just like Don really could have called out the National Guard himself on Jan 6th, as he has demonstrated in real time that he can do any time he wants, the stacked MAGA supremacist court is all set up to deliver the dictator everything he wants, and they support.

    Unlike those fun German folks back in the ’30s, where communications were sporadic or non-existent at best, this is happening in real time, covered 24/7 by every news and social media outlet. The German people have a sliver of an excuse. WE have none.

    I’m happy to be wrong, but I doubt the Supreme Court will do the right thing.

  39. Mark my words: this one is getting overturned. I’m an attorney and while it makes little sense to overturn the decision, it will be.

    The dissent in the appeals court decision gives all the justification SCOTUS needs to say the IEEPA gives Trump carte blanche to impose whatever tariff he wants at whatever percentage he wants against any nation he wants on any dubious “emergency” basis he announces.

    It’s sad to see the checks and balances I studied so hard once upon a time be swept aside in the name of power and ideology. It’s sad to see the Court twist itself into saying that legislative authority prohibits once President from canceling student loans while another president can use the world’s most sprawling, unrestricted interpretation of statute in completely usurping Congress’s constitutional role in enacting tariffs.

    SCOTUS is an embarrassment and I thank whatever god an atheist thanks that I’m privileged enough to be leaving this country within the month. Good luck to everyone who has to continue living through this nightmare in the coming years.

  42. I will never forget or forgive the Republicans who slow walked Obama’s Supreme Court nominee, because the Senate deemed it inappropriate to allow the hearing to occur. Only for them to speed run Trump’s.

    They are traitors to this country.

    They let politics and personal allegiance become the primary motivation in being in office and destroy the judicial branch of our government.

    If there is a god, they’d be held accountable for their sins. But there isn’t, and that’s why these guys do it and get away with it.

  43. Why bother? Just get a big rubber stamp that says “overturned” and use it on every lower court decision unfavorable to Trump. No need to try and make up a constitution-based reason for the decision, I think we can all drop the pretense at this point.
