My girlfriend is looking for a job as a graphic designer and stumbled upon this. ADF international. Some US conservative lobby group. It seems like they should not be able to ask you about your faith on job application. At least in my country it's not legal. Is this legal in Austria? The job is in Vienna.

EDIT: she does not want to work there. It was just weird thing she found among other job postings.

  1. I don’t think that’s someone you’d want to work for anyway. But since they’re US-based, I’d assume they can get away with stuff like this even in Austria.

    ADF International is a forefront organization for MAGA Trumpism. I guess they don’t really care if that is legal or not. Just look at Trump.

  8. It depends. If the organisation itself is part of a recognised church (in Austria, not US) then it is allowed under the “Konkordat”. Otherwise not.

  9. It depends. Employers are not allowed to be discriminatory in the hiring process, but if the information is relevant, they can ask for details normally not allowed.

    Someone hiring security for a synagogue probably is allowed to ask the religious opinions of applicants. A fast food chain wouldn’t.

    So, it is not a easy yes/no.

    However, its also a great sign that you should just not work for them. Not to mention that they’re christian fundamentalists with extremist viewpoints and shouldn’t even exist as an organization in our secular country, but thats a broader discussion to have.

    There is a exception for religious organisations, but there it also comes often to arguments like is it essential for a hospital run by an catholic order to be all people there catholic, even it has nothing to do with the job?

  19. No, it’s not legal to ask faith-based questions in this specific context.

    Asking about religion in job ads/interviews is not completely forbidden, but requires an objectively verifiable direct connection between religious affiliation and the job in question, according to a ruling by the Court of Justice of the European Union (CJEU).

    This might be permissible for a priest, for example, but certainly not for a graphic designer.

    The job advertisement is also missing other legally mandated information, such the the [minimum salary](https://www.wko.at/einstellen/angabe-mindestentgelts-stelleninserat).

    You or your girlfriend could report this posting. However, the fines for such violations are pretty low and first-time offenders usually get off with a warning.

  22. It is absolutely illegal in Austria to ask questions about religious belief, sexual orientation or political affiliation in job interviews. Doing so is an offence and can result in court proceedings if the applicant lodges a complaint at the Arbeiterkammer.

  25. Definitely not legal in a job ad. It’s like writing “male only applications”.

    This is in direct violation with constitutional law (Verfassungsgesetz) and is clear case of discrimination.

  26. Pretty sure it’s legal if your religious views have an impact on you being able to do the job. I’m guessing if you are a graphic designer who fundamentally disagrees with the views and values of the organisation you are supposed to represent, maybe you won’t be able to understand the audience they are trying to reach.
