Some have speculated that one way for Trump to get a third term as POTUS is for him to run as vice president, and then have the top resign on day one thus putting him back in power.

I do not believe this to be a legal method because I believe that Trump would not be eligible to be vice president either.  This is because the prime eligibility requirements of VP are the same as for the POTUS.  Namely:

The U.S. Constitution states that the president must:

In addition, I believe it implied that the VP must be eligible to be POTUS on day one if elected.  Trump, or any other two-term president like Obama or Dubya Bush, would not be eligible to resume the POTUS position via a hypothetical elected VP to POTUS route.

As per the 22nd Amendment:

22nd Amendment, Section 1. No person shall be elected to the office of the President more than twice, and no person who has held the office of President, or acted as President, for more than two years of a term to which some other person was elected President shall be elected to the office of the President more than once.

All that being said, with the current corrupt mob of malevolent toadies on the Supreme Court and their creative use of twisted legalese, anything might be possible, but from my understanding of the text, Trump should not be able to get a third term, assuming he is still extant in body and mind in 2028.

All IMHO.
