  5. The young girl was grabbed into a headlock and stabbed 8 times. Injuries covered her face, neck and shoulder. She was coming out of a Lego shop for fuck sake. Her life will now be everything before going to look at Lego, and everything after.

    Yes it sounds bad but he’s not exactly out on the street.

    Guy is probably schizophrenic, which makes intent impossible to prove legally. We don’t have enought people working or enough facilities to keep the public safe from people suffering with serious mental health disorders, which lies with our political leaders.

  9. The CPS downgrade charges for many reasons. In this case it’s most likely they’ll run with GBH /attempted GBH etc as a charge and not attempted murder, because the criteria for it is so much higher – and so they’re hedging their bets so theyre more likely to win the case.

    The daily mail prints “MURDER CHARGED DROPPED. NO EXPLANATION GIVEN”

    And the thicko public add it to their list of ‘things broken in britain’

    There should be no other evidence required other than “Had knife, stabbed human”.

  12. I appreciate he’s still being sentenced for the crime within the bounds of the law, but I honestly think if you’ve stabbed someone the fact they didn’t die doesn’t been they couldn’t have. I doubt he stabbed her in an attempt to not be lethal, nor that he has the biological knowledge and skill to do that if he wanted to. Therefore, it was attempted murder.

  13. This isn’t anything new. He was charged with two similar offences and pled guilty to the Lower offence.
    Wounding with intent and attempted murder both carry maximum sentences of life imprisonment. Given that he is being held in a secure medical unit the CPS have rightly decided that the tens to hundreds of thousands of £s of cost to bring about a trail at crown court for no real difference in sentencing, if they could win it at all given that the defendant is considered not to have mental Capacity. The legal difference between Attempt murder and Wounding with intent is all about the intent of the defendant. As they have been deemed by medical professionals not to have capacity that intent would be difficult to prove.

  15. If you take the time to read beyond the headline, he was unable to attend the hearing and is being held in a high security hospital

    This indicates that he is likely very mentally disturbed and proving intent would be extremely difficult, and the way the law stands, there needs to be intent to murder

    Regardless, GBH can result in a life sentence, and I cannot see this fella getting out anytime soon, he won’t be getting away with anything and he will be getting severely punished

  17. Ahh a clickbait title to rile up the commenters who have no legal understanding and will take a headline at face value.

    Quick remedy for those willing to actually question what is going on:

    He was found guilty of GBH (gross bodily harm). When you attack somebody there are a number of things you could be charged with murder/attempted murder/manslaughter/GBH/etc etc.

    Some of these are harder to prove than others.

    The punishments that can be given often have overlapping ranges.

    This means the prosecution have a choice, let them plead guilty to a “lesser” GBH and get justice quickly and have similar sentencing, or maybe go to court (delayed due to court backlog), spend many hours and taxpayer pounds proving attempted murder, and have a chance to fail and have them walk free.

    The faster, cheaper, most surefire way of getting these wronguns in prison is the plea deal.

    Yet rags like the DM will treat you like an idiot and make it seem like *BAD FOREIGN MAN IS LET OFF BY LEFTY LAWYERS!!!!!!* because it pushes their narrative.

  19. Not a lawyer but this is likely related to what the CPS believe they can prove. Attempt murder is really hard to actually prove because you need to be able to show the pre-meditation which is obviously far more difficult than just proving he did it.

    They may not want to run the risk of him getting a not guilty verdict because they couldnt prove the charge.

  35. If attempted murder charge is harder to prove and would enable the offender to be let off, this just show that our entire justice system is broken and rotten

    Common sense is gone these day and UK seem to be a Paradise for scammers, sociopath and killers

    Also, it is claimed the offender is schizophrenia. That still no excuse for what he did, and there is a clear threat to public. However, we do have justice system that encourage guilty parties to claim they re suffering from MH to get away with lighter sentencing or be sentenced under different rulings. Again, broken system.
