    The Inakosť Initiative criticizes the proposal because it compares it to declaring a spouse dead. Minister of Justice Boris Susko (Smer) submitted the new Civil Code for comment at the beginning of October with the aim of modernizing and making our law more accessible, since the current code dates from 1964 (from the times of socialism) and did not regulate transition issues. The new Civil Code, which is to be in force from 2027, thinks about this issue, but significantly complicates life for transgender people.

    The state plans to automatically dissolve marriages of persons after gender reassignment, without ascertaining the will of the partners. The new Civil Code states that “Marriage shall be dissolved by the change of the spouse’s gender” this provision follows immediately after the point on declaring the spouse dead. In practice, the change means automatic divorce, after which property and rights to children are resolved in the same way as after a regular divorce.

    Yes they do want to allow for instant divorce if one spouse transitions, but the declaring the dead is not happening. The advocacy group Inakosť (a Slovak LGBT rights organization) strongly criticizes the proposal, saying it is harmful, discriminatory, and dehumanizing. They point out that it effectively “declares a person dead” in terms of their marriage status. Not literally dead.

    Their marriage will be ended the same way as if one spouse died. But you will not literally be declared dead.

  25. To everyone thinking this is a great way to avoid taxes because the dead don’t pay taxes, I think there’s a bigger concern. Dead people don’t own property, or get social services, or jobs.
