The ECHR isn’t just a court it’s a treaty. The “rights” set out in the treaty are also enforceable by U.K. courts which is a fundamental element of the treaty. This means it’s rare that a case had to actually go to the ECHR courts because British courts enforce the treaty anyway, they have to by law.
When we talk about leaving the ECHR it means the TREATY as well as the court itself meaning British courts will no longer have to enforce the details of the treaty in U.K. courts.
