  1. What do yall think of this? Seems like a way to bypass the national law. This change was triggered by a case of two Polish men

  2. Before people jump to conclusions, this does not mean every country must allow same-sex marriage. It rather means they must recognise same-sex marriages performed in other EU countries. The rationale is that failing to do so undermines the EU’s freedom of movement rules.

  3. As usual law will be dead in poland, our lovely government will just pay fines to eu.

  4. As usually – when EU court say something that is against our constitution, our gov will just pay the fine and let it go. What’s more they can do? It is impossible to recognize it, at least not as marriage. There are some tries to bring it in limited way recognized as partnership but not marriage. But even this is very unlikely. Not in next 5 years for sure. And in practice much longer.

  5. Things are kind of boiling up in Polish politics right now with a weak government and an election around the corner. This will be used to mobilise the PiS electorate because ” the west is pushing gayness on us “

    We all know that this will not happen, unless the government wants to lose the next election by 100% chance.

  7. This judgment should never been proclamated. Why? Because this court cannot rule on the Charter of Fundamental Rights in Poland. Poland has secured this exclusion through a relevant protocol to the Lisbon Treaty.

  8. That’s against Polish constitution. Preety hard to bypass this. No legal framework can be made to “pull this through”. Eventually – “partnership agreement” or other construct parallel to marriage.

    If that would be implemented – this would mean that top tribunal jurisdiction is effectively in Luxembourg.

    Expansion: If this “order” would be implemented- that technically allows to undermine any article in constitution. Power balances, legal system, parliament setup 🙃

    Hence – that’s not happening.

  9. I always wonder what makes so many people so upset about a few gays. It’s not contagious, it doesn’t take anything away from them, you can still be miserable in your heterosexual marriage. Or is it that? Jealousy? Can’t stand others being happy?
    Disclaimer: I’m heterosexual, I just don’t give a fuck who consenting adults have sex with.

  10. I doubt this will change something now- Poland should recognize that marriages long before (EU law) we pay much because we dont obey it even if we agreee long ago.

    But is good news and can by base for future changes. I will use this if some real law will become true in poland. I am with my Boyfriend longer than 9 years- we will marry here but cant.
