Hello All,

Sorry for the bad image. The image shows two lines drawn – Green & Red Color. I am represented by the Green color. The red car is a Polish-registered car.

At around 10:20 PM, I was in the right lane of the two lanes entering the Luisenring. I stayed on my lane – I didn't cross over onto other lanes.

The red car turned onto my lane at the end of the curve.
My Car was damaged on the front left bumper. The red car was damaged on the right side of the front door.

These satellite images aren't up-to-date. There is a Solid line between those 2 lanes along with a broken line such that the red car can cross onto the green car's lane and not other way.

Here is what surprises me – The Red car driver says I'm at fault, saying i crossed into his lane.
I stopped the car where the accident took place. He moved the car to continue a bit and stops few feet ahead.

There were 2 witnesses – one of whom was driving behind(witness 1) he said. Another was walking by (witness 2).
Witness 1 mentioned I was at fault and explained a bit – I could not accept it when he said I was in the left lane. I was shocked – because I was in the right lane at the signal. My German is not good enough to explain to him that he is fundamentally wrong.

The witness 2 said I am at the wrong – no explanations. And when I tried to talk about the technicalities when we were waiting for the police, he mentioned that he has no driving license. i mention this just in case it makes any sense.

I'm ok if I'm at fault. But I feel I am not at fault. I'm a bit of an introvert – I cannot force my views openly. I hesitate to do so. The witnesses are not purposely lying – they're just mistaken. At least the witness 1.

I did explain the technicalities as to why I could not have been at fault – Police said he understands what I am saying – but he said there's nothing he could do.

What do you suggest I do here? Is there a way I can do something about this issue? I feel I am just suppressed by others' opinions.

P.S: Just after the accident occurred, we setup the warning triange at a distance. A man driving at relatively high speed hit my car from behind at the accident scene. He was drunk – the police confirmed.

  2. i can’t stress this enough but get a dashcam asap.

    especially “mehrspuriges abbiegen” is a total disaster in germany

    and ppl can’t own it if they are in the wrong

  3. I would say red car is at fault. The lines are almost entirely gone in the satellite image and the layout is very unintuitive, so I would have understood the confusion. But if they actually painted properly visible lines on the roads I think there should be no doubt.

    I hope the witness accounts and your language barrier aren’t going to lead to a negative outcome for you. You should definitely lawyer up in that case (perhaps talk to your insurance about that)

    Isn’t your lane the second from left?

  5. If the lanes are like shown in the photo, you were in the wrong lane. Your lane was to your right, next to the right-turn lane. The lane you used was for the other car (red).

    Edit:
    I’ve checked streetview. You are correct, the red line should go to the far left lane and you can choose whatever lane.

  6. Likely whoever marked those lanes is at fault. This really looks like what you describe as your perceived lane in that picture, but that’s not how one would construct an intersection.

    The way I see it:
    – Green can freely choose between the right three lanes
    – Green is not allowed to go to the left most lane (you cannot cross a solid line)
    – Red is designated to go to the left most lane
    – Red can switch lanes since they have the dashed line. BUT! Red would be performing a lane change and thus has to ensure that this maneuver is doable without endangerment

    From the damage you’ve described it reads like Red didn’t do a “Schulterblick” and did not see you. So I see red at fault here.

    Of course I’m not a lawyer.

    Anyways. Doing a lane change while turning is stupid as fuck.

  8. After looking at the newly painted markings on street view I assume the red car is in the wrong. But perhaps there is a technicality I don’t know about.

  9. I don’t have anything to add about your accident, but how is being introverted related to being open to ther people’s opinions?
    The scale of introversion and extroversion simply describes whether you draw more energy from alone-time or time spent socially.
