A man raped a “terrified” woman in the vehicle entry bay of the court building where the trial is taking place, a jury has heard. Mubarak Ibrehim, 25, who is Sudanese, is also accused of voyeurism by filming the incident on his mobile phone.

The alleged attack happened in the early hours of June 11 2025 outside Portsmouth Crown Court. Ed Hand, prosecuting, told the jury that the complainant had left the Astoria nightclub in the city centre with a friend at about 3am. The friend then began talking to another male and went into an alleyway to buy some drugs from him while the complainant sat on a kerb waiting for her because the complainant “did not want to be involved”, Mr Hand said.

He added that the defendant, initially accompanied by another man, stopped to talk to the complainant before the other man left them alone.

The prosecutor said that the pair were captured on CCTV footage and added: “He sat down next to her, he can be seen to kiss her and put his arm around her and after a short while they walk off camera and disappear out of shot for about five minutes in the vehicle bay of this building.

“The pair then reappear and walk off together before the defendant walks off in the opposite direction.”

Mr Hand said that the complainant was “extremely upset” and the police were alerted and attended the scene.

He said that in police interview, the complainant said that when the pair were in the vehicle bay, the defendant “became more forceful, pulled down her trousers and raped her”.

He added: “She told police she was terrified and she froze.”

Mr Hand said that she had been unaware that Ibrehim had filmed the incident on his phone and when she was informed about it, she told police that “it made her feel physically sick”.

On the footage of the incident found on the defendant’s mobile phone, a male voice can be heard saying “don’t worry”, the court was told.

Mr Hand said that the defendant sent a WhatsApp message the following day to the complainant saying: “I really enjoyed meeting you at the party last night, do you remember me?”

He said that the complainant sent him a message saying: “You, you’re the one who hurt me, do you understand how drunk I was, taking advantage of me the way you did.”

After she sent another message saying: “I know it’s you, you were him.” Ibrehim then stopped replying.

Mr Hand said that after Ibrehim, who is being assisted during the trial by an Egyptian Arabic interpreter, was arrested he told police that the complainant had consented to the sex.

He added: “He admitted using his phone to film some of the incident because he wanted to show she had consented.”

Mr Hand added that the complainant had stopped the incident because he was “afraid of being seen”.

The jury was told they will be taken to the scene of the incident in a site visit.

Judge Daniel Sawyer said: “Ordinarily I would tell you not to go to the location but in this case it’s just out the back of the building and it would be utterly pointless, you can see most of it from your jury retiring room.”

Ibrehim denies the offences.
