Working without a contract: why is this a major mistake?

Starting work without a signed contract is one of the most common and at the same time most dangerous situations for employees. Even if the employer explains this as a ‘trial period’, the absence of a contract effectively leaves the person without any guarantees. In this case, the employee has no legal leverage in the event of delayed or non-payment of wages or a conflict with the employer.

The contract can be in paper or electronic form — the key thing is that it exists and is signed before the start of work.

Overly attractive job offers as a warning sign

Advertisements offering high salaries, minimal requirements and no language skills often look attractive, but they should raise alarm bells. Such offers often hide unfavourable conditions that are not immediately disclosed, or outright fraudulent schemes.

Experts advise to critically evaluate such vacancies and check the employer before leaving.

In the previous article, we talked about where Ukrainians most often find work in Poland.

‘Grey’ wages: why is this a risk not only for the employer?

Paying wages ‘under the table’ remains a common practice, but it deprives the employee of social guarantees. In the case of unofficial payments, a person risks being left without pension contributions, medical insurance and protection during inspections. Legal registration of income is a requirement of the law and a basic level of security for the employee.

Experts also advise, if possible, to choose an employment contract rather than a civil law agreement. Employment relationships provide for paid leave, sick leave and a higher level of protection against sudden dismissal. Civil law contracts, although they may seem simpler, do not guarantee such rights.

asked questions

Is it possible to work in Poland without an official contract?

Working without a signed contract means no legal protection, no guarantees of salary payments, and no social security contributions. In the event of a conflict with your employer, it will be almost impossible to prove that you were employed.

Which contract is better for working in Poland — an employment contract or a civil law contract?

An employment contract (umowa o pracę) provides more guarantees: paid leave, sick leave and protection against dismissal. Civil law contracts (umowa zlecenie, umowa o dzieło) have a limited level of social protection.

How to check an employer in Poland before getting a job?

It is recommended to check the official registration of the company, employee reviews and the terms of the contract. If in doubt, it is worth consulting a lawyer who specialises in employment abroad.
