Vice President JD Vance criticized the Supreme Court following their ruling that opposed the administration’s tariff approach; his remarks, however, drew backlash from conservatives.
On February 20, the Supreme Court dealt a significant blow to President Donald Trump’s signature tariff policy. In a 6–3 decision, SCOTUS ruled that the 79-year-old president did not have the legal power to levy tariffs using the International Emergency Economic Powers Act.
In response to the verdict, the 41-year-old Vance took to X, formerly known as Twitter, to express his frustration, writing, “Today, the Supreme Court decided that Congress, despite giving the president the ability to ‘regulate imports,’ didn’t actually mean it.

“This is lawlessness from the Court, plain and simple. And its only effect will be to make it harder for the president to protect American industries and supply chain resiliency.
“President Trump has a wide range of other tariff powers, and he will use them to defend American workers and advance this administration’s trade priorities,” Vance concluded.
After Fox News circulated Vance’s comments on social media, their followers pushed back against the vice president and sided with the Court, supporting their judgment, reports the Express US.
One individual commented, “The Supreme Court’s 6-3 ruling upholding separation of powers is correct and welcome. Presidents can’t unilaterally impose broad tariffs via emergency laws like IEEPA Congress holds the purse strings. Vance’s ‘lawlessness’ claim ignores constitutional checks that protect the economy from unchecked executive overreach.”
Another individual remarked, “JD Vance, dangerous rhetoric that makes you unfit for office. Calling a carefully considered 6-3 ruling ‘lawlessness,’ just because you disagree is unAmerican.”
A third commented, “‘Lawlessness from the Court’ because they limited executive power? That’s not how this works. If the Supreme Court interprets what Congress actually authorized, that’s literally their job. You don’t get to scream ‘lawless’ every time a ruling doesn’t go your way. Checks and balances aren’t optional. They’re the point.”
While Vance faced criticism for his remarks, he did receive backing from one supporter who stated, “Let the tariffs stand. They helped a lot of people keep jobs here in the U.S.”
Lower courts have previously ruled that Trump’s IEEPA tariffs are unlawful.
On the same day, Trump criticized the Supreme Court’s decision during a White House press conference. He alleged that the judges had been “swayed” by foreign interests, which he claimed influenced their vote to overturn his tariff policies.
“It’s my opinion that the court has been swayed by foreign interests by a political movement that is far smaller than people ever think,” Trump said.
He also labeled the justices who ruled against him a “disgrace” and “fools and lapdogs.”
Trump suggested he might implement a 10 percent tariff using alternative legislation, which would grant him authority to impose tariffs for 150 days before Congress would need to intervene.
