Hey all 🙂 Wow my first reddit post…after many years as a deep reading nerd.

I’m a Canadian citizen that has lived in Germany for the past 7 years with a freelancer/artist visa.
My girlfriend of 3 years is a Danish citizen. We’ve spent extended periods of time at each other’s respective flats in Copenhagen and Berlin over the past 3 years (particularly during the pandemic of course) but have never actually registered at each other’s address because she’s been studying in Denmark/I’m Canadian and…Denmark LOL.

We’d like do move to Copenhagen where she owns a flat. I can do my work anywhere and make well above the German average income and have plentiful savings. So that isn’t an issue.
However, we’re looking to do it through the EU rules and I’m a bit confused about exactly how long we need to live in another EU country (in this case it would be Germany most likely as I’m already registered here and have almost a decade of tax returns).

The NyIDenmark official site says we need a minimum of 18 months co-habitation.

Also many posts here also reference only 3 months.

What is the actual amount of time we need to live together in another EU country?

Any help and clarity would be sooo appreciated.

  1. I don’t know much about family reunification under the EU regulations, but I do know that it’s the conditions listed on nyidanmark.dk that counts. Regardless of what ægteskabudengrænser.dk says.

    If you’re in doubt then you’d be best off by contacting SIRI, the immigration office on the matter. If I remember correctly, Ægteskab Uden Grænser is largely based on volunteers who may or may not know about the rules. In any case, you best move will always be contacting the organization behind the permit – SIRI.

  2. The 3 months is the time your girlfriend must have lived in Germany to be considered under EU law instead of Danish law when moving back.

    Just get married …

  3. If you aren’t married it’s 18month. But just get married. It is super quick and free in Denmark (since your GF is Danish), then you just need 3 months.

    My wife and I lived in Sweden for a year before moving to Denmark (but we could have moved after 3 month).
