Last chance to cash in on Krispy Kreme’s $1.6M settlement

Two years ago, one of the nation’s most popular doughnut shops was involved in a major data security incident. Now, Krispy Kreme has agreed to a massive settlement, and Texas residents may be able to benefit from it.

However, time is running short to file a claim. The deadline to submit a form and potentially cash in on the $1.6 million payout is Monday, June 22.

The settlement follows a class action complaint filed by plaintiff Fortesa Bobo against the North Carolina-founded chain on June 20, 2025, according to a notice filed in the U.S. District Court for the District of North Carolina, Charlotte Division. Because several people were involved in the alleged information breach, additional lawsuits quickly followed. To date, 12 additional related actions have been filed against the bakery business, court records show. 

After years of litigation, the plaintiffs (Bobo and others in similar situations) and the defendant (Krispy Kreme Doughnut Corporation) do not agree on the legal claims being asserted in court.

“The lawsuit has not gone to trial, and the court has not decided in favor of the plaintiffs or the defendant,” the official settlement website states. “The class representatives, defendant, and their lawyers believe the settlement is best for the settlement class because of the settlement class member benefits available and the risks and uncertainty associated with continuing the lawsuit.”

Plaintiffs allege that Krispy Kreme failed to adequately secure and safeguard the sensitive information of current and former employees, according to the lawsuit. The information included Social Security numbers, dates of birth, driver’s licenses or state ID numbers, debit card numbers, and more, the document states.

The claim was sparked by an event on or about November 29, 2024, when the company “became aware of unauthorized activity on its network systems, causing the wrongful exposure of the details of 161,676 individuals,” according to the complaint.

According to the settlement agreement, which is pending approval by the court, eligible folks who file a claim by the deadline with reasonable documentation for losses may receive cash compensation of up to $3,500.00. Others who do not provide documentation could get $75.

“Without submitting a claim form, you will receive access to one year of credit monitoring,” the settlement website states. “You should have received your activation code on your postcard notice. If you did not get a postcard notice, you can obtain your code from the settlement administrator.”

According to the settlement website, you are eligible if you reside in the U.S. and were sent a notice of the data incident stating that your private information may have been affected.
