Plaintiffs alleging they were injured by a data breach of Accellion Inc.’s file-transfer software failed to convince a federal court to reconsider its decision to certify subclasses in the litigation for nominal damages only.
The plaintiffs failed to offer newly discovered facts or law in support of their motion for modification of the original class certification order, Judge Edward J. Davila, of the US District Court for the Northern District of California, said Wednesday.
Because there was no basis for reconsideration, Davila struck the renewed motion for class certification.
