A federal court dismissed proposed class action by four non-citizens in Ohio who accused federal immigration enforcement agencies of warrantless arrests without probable cause.

Defendants— including the Department of Homeland Security, US Border Patrol, and Immigration and Customs Enforcement— “in some instances” unlawfully arrested and detained non-citizens without a warrant, said Judge Sarah D. Morrison of the US District Court of the Southern District of Ohio. But plaintiffs’ request lacks standing because they seek “forward-looking, declaratory and injunctive relief” without ongoing or imminent harm, according to the opinion.
