Assault causing harm sentence to double from 5 to 10 years under new domestic violence strategy | theJournal.ie

  1. It’s a great idea and I’d say doesn’t go far enough but, will a judge actually send anyone to prison and utilise the new sentences? Or will they follow the usual of a donation to the poor box and let people go on like nothing happened?

  2. Good to see this being treated more harshly but I feel like this essentially means a doubling of the suspended sentences. The judiciary are woeful at handing out custodial sentences here. How many times do we see extensive numbers of prior offences yet a suspended sentence is given.

Have to wonder what effect this has on prosecution rates given the time and effort put into cases to see the guilty person walk out free after.

  3. Next, make sure this applies to everyone under 18 too because they still know what they are doing assaulting someone while they are under 18, ie. Being able to tell right from wrong.

  4. It’s something positive, on top of the Coercion legislation that the Government brought in last year. In fact, coercion is a massive part of domestic abuse in this country. The only very negative point is the minister is using Tusla to get it up and running, and they are notoriously slow, understaffed and ineffective in many respects. I think having to even get involved with Tusla will put many women off because of the concerns that they’ll concentrate on the children rather than the mother, and the fear of losing the children, or even having to report to Tusla, is a huge deterrent about going to Tusla.

As such, it doesn’t seem to be well thought through, a bit rushed perhaps.

  5. Politicians love increasing sentences, increasing fines etc.. because it can be done at the stroke of a pen. They’re not so keen on investing money or changing processes so that those things actually have an effect. I’m not aware of any party that supports adding extra prison capacity. Also, it has been shown time and time again that likelihood of being caught is a more effective deterrent than the size of the punishment.

  6. Is incarceration the most effective way to achieve the goal of reducing domestic violence?

I’m always extremely skeptical of these “zero tolerance” criminal policies, and while the other measures are fantastic (increased resources for victims of domestic abuse) are we really dealing with the root cause by locking people up – granted that requires judges to actually enforce the sentence. Can’t help but feel its an emotional measure that will make people feel better but not actually reduce victimisation in an appreciable way.

  7. Just reading some lad got 3 years for abusing his 7 year old sister.

    3 fuckin years for that…

Why is sexual abuse completely allowed in Irish justice system. Sexual abuse does untold damage to a person…they should be locked away for 20 years.

This is why we have a big problem with sexual abuse and anti social behaviour in Ireland. Suspended sentence for everyone who doesn’t follow the law.

If you do follow the law they will fuck your life because they gotta make an example out of you if you do anything even as much as stealing a urinal cake they will fuck your life..but the scrotes? A pat on the back and out the door ready to throw some more stones at bus.
