All we can see from the picture is a cosmetic issue.
If the rust is only external and has not yet dissolved any load-bearing parts, there should be no problem. But with just a picture from a distance it is difficult to judge and by no means to say with certainty.

If it does matter just tell them that you asked the Internet and they were fine with it.

Just tell your TÜV-Prüfer that you had problems with memory Managment and so you changed from c++ to rust.

From my experience, I was told that if they can puncture it with a screwdriver, then that is enough reason to fail. It does not matter if it is on the door, or on the main skeleton of the car. A the end, I had to sell my car.
I do body work in germany and can see its all the way through, and they dont like it when there are holes. I would get it fixed asap, its right behind the back tire so it will continue to fill with water, mud, and whatever else. It will continue to rust and at a faster rate. Get it fixed before you have s swimming pool in the trunk/boot. It wont be super cheap either, they will have to cut that piece out and try and save the inner wheel well, thats where the bumper attaches so it wont be super easy as everything will have to look nice.
Not 100% sure but I’m pretty certain the rust will only effect your ability to pass if it’s structural, and not just surface rust. This just seems like a cosmetic issue

it wont be an issue since its not on the frame. however, it doesnt make you look good there in general, if the engineer sees stuff like this, he will check it better than if you go there with a car in otherwise mint condition. even if there is no rule stating that, its just a human reaction. if the car is well looked after and makes a good general impression, you will get away with a lot of little things most likely.
however, if your car has rustholes on its body panels, chances are pretty high that there are other problems too, as soon as there is significant rust on load bearing parts of the vehicle, its game over. it doesnt even have to be a hole rusted into it, signs of a compromised structural integrity suffice to not give you the seal of approval
I had an old Citroën and it had some rust at bottom of the hatchback luggage door, TUV said it needs to be completely replaced which didn’t make any sense to me.
