A lawsuit against Suncor Energy over alleged air pollution from its Colorado refineries can move forward in spite of the company’s existing settlements with the EPA and state regulators, a federal appeals court ruled Monday.
The decision by the US Court of Appeals for the Tenth Circuit reverses a May 2025 lower court decision that granted Suncor’s motion to have the suit tossed.
