I am writing in English because I am not sure my French is good enough to convey what I need.

I know someone 22M who is in an apprentissage en patisserie/chocolaterie.

He goes to school 1-2 weeks a month during his alternance, for the month of December he does not go to school at all.

His pay is for contrat d’apprentissage, when he does extra hours they count as supplemental hours. He works in place of an Ouvrier because neither of his bosses have qualifications nor do they have a chocolatier. All while getting paid like an apprenti. He recently told me he just started officially getting 30 minute lunch breaks, signifying that before this week he had never taken a lunch break. His schedule is 10:30 to 5:30 but usually works more like 10:30 to 7:30/8:30. He used to have two days off, Tuesdays and Sundays. They have just informed him that he will be only getting Tuesdays off.

Contrat d’apprentissage is 35 hours a week, can they make him work more than that? They also try to make him come the weekends when it is his week of alternance and spends the whole week at school. I am trying to understand what his rights are so that he isn’t working hard just for breadcrumbs.

    Truth is, this looks like standard pratice in this field.

    Yes, you friend has rights as you already looked it up, but law isnt applied as it should everywhere.

    In this field, les Boulangeries artisanales, it is common pratice to work more than what you’re really paid for.

    It is considered rude and lazy to refuse, it comes from old times when one had to give eveything to the company. Especially for apprentices, since they’re there to ‘learn’.

    Your friend has little to no outs. Very few Boulangerie artisanales respect the Law. If he speaks up, there is a high probability that it will end badly : either he will be screamed at everyday for the rest of his contract or he will be put away, not given anything to do.
