LSS: I cannot process a Niederlassungserlaubnis because I require to have 6 months of working contract after my appointment. I did not know about that information, the responsible person does not have interest to help and I do not know what to do about it.

I have been living in Germany for almost 6 years, I did my master and I continued as a PhD student. Two days ago I received my results from the german certification B1 and I approved it (yay!). Also one month ago I got the certification of approving the test “Leben in Deutschland”. My aim is to get the permanent residence permission and finally I had everything to get it. As a PhD student I have a working contract, so also I have being paying taxes.

Previously I got an email for an appointment to renovate my permission, which is fixed for mid August, and yesterday I sent an email to announce that I would like to get my permanent residence permission, I attached the certificates and I asked if, besides the list of documents mentioned in their fist email, I should bring something else. Also I mentioned that I got an extension of my contract for three months more (in order to wrap up my PhD), and I was not sure if I would get the copy of the contract before the meeting, so, I asked for advice about the section regarding “information about sufficient means of subsistence”.

Anyway, I got a reply ignoring the last question and only stating that unfortunately I cannot obtain the Niederlassungserlaubnis since I have less than six months of contract after the appointment. I was not aware of such requirement, it is not detailed like that in the website ([https://www.dresden.de/de/rathaus/dienstleistungen/niederlassungserlaubnis\_d115.php](https://www.dresden.de/de/rathaus/dienstleistungen/niederlassungserlaubnis_d115.php)) and it feels so bad because I did not contact them before because I was waiting for the results of my certifications (six weeks for the German language certificate) I did the examination in May, and I wanted to do it in April, but in late February, when I tried to book an a place for the exam, I found out that there were no spots available.

I decided to email them once more explaining that situation, and also mentioning my concern of having to pay for the residence permit for the 3 months of contract extension, then for “job seeking”, then once more when I get a job and, after 3-6 months, pay for the Niederlassungserlaubnis.

What kind of reply I got, “we do not have earlier appointments, please take the appointment that you already have”. This person ignored almost my whole email. I politely asked to please reply to the other points/questions of my email, and I can notice from his reply that he has zero interest to help.

I wrote the emails in German, hopping that there is no misunderstanding because of the language. A German friend went through the website and some regulations mentioned there, and he could not find something regarding the 6 months of working contract after the appointment.

I wonder if someone here can give me a hint of what to do, it feels unfair, specially since a friend told me that he only showed a certification of attending a German course and, without doing the test “Leben in Deutschalnd” he got his Niederlassungserlaubnis. I do not wanna pay around 400 euros for the next residence permissions that I mentioned above.

Thank you for your attention.
