That only applies to compensation cases (so civil as oppposed to criminal). If the diplomat isn’t in the UK and has no assets in the UK then the chances of getting money out of them will be slim.
Mixed feelings about this one. Obviously the sort of treatment described in the article is abhorrent and you want to see the people who do these things not simply get away with them.
HOWEVER if you punch even tiny holes in the inviolate nature of diplomatic immunity you are creating possible ways for other countries to pressure YOUR diplomats.
But OUR diplomats would never behave in such a terrible way, I hear you think…. well, even if they don’t, it doesn’t stop some less-than-forthright country just plain making shit up.
Diplomatic immunity is supposed to mean “the worst we can ever do to your diplomat, is ask them to leave”. And there’s very important reasons why that is so.
