My parents have been victim to this multiple times.
In 2019 they caught the parcels, returned them, filed a police report and told Zalando never to send them anything again. But earlier this year one was successfully picked up by the fraudster and they started receiving payment reminders, eventually from the collection agency too. Fortunately the collection agency is not entirely incompetent and they stopped after seeing the police report.
Zalando doesn’t take the issue seriously, it’s been going on for years and the police officers told them they’re taking 50+ complaints per week across the canton.
I don’t know about Konsumentenschutz, but in Romandie the FRC is well aware. I’m not aware of any serious action though.
Consumer protection can really suck in Switzerland sometimes… Moronic companies like Zalando who ship 500-600 CHF worth of orders to new customers without being paid should have to clean up their own mess, and not just offload the burden to the victims.
In the meantime I advise everyone to create an online account with the Post. This way you get email notifications for all incoming parcels.
By law the companies have to proof that YOU did the order/ buy it. Just saying there is your name on it doesn’t count. So vice versa YOU DONT have to proof that you didn’t order it. Very important!
I feel so naive every time a read about something like this. Like seriously it never even crossed my mind…
Does this mean i can buy online something and just say it wasn’t me and that i never received it and i won’t have to pay it?
