Veel slechte publiciteit voor Decathlon voor de paar duizend euro dat die fiets maximaal kost.

Het eigendom gaat over van verkoper op koper op het moment dat er een wilsovereenstemming wordt bereikt. Vanaf er loutere consensus is over de verkoop, wordt het goed het jouwe en is de verbintenis bindend, ookal staat het niet op papier
Eigendoms- en risico overdracht voor roerende goederen gebeurt in principe op het moment van overeenkomst, niet noodzakelijk op moment van levering. Tenzij natuurlijk anders bepaald in de overeenkomst / algemene voorwaarden. (Art. 1583 burgerlijk wetboek)

Het punt is dat ze hier sowieso al beiden hebben plaatsgevonden.
De man gaat eerst naar de afhaalbalie, krijgt zijn fiets (die hij al betaalde) mee. Neemt vervolgens de fiets mee de winkel in om daar wat accessoires te halen en daar wordt hij vervolgens gestolen.
That’s not what happened though. He paid online, got his bike at the counter and then desides to leave it unattended.
I don’t see why Decathlon would have any responsibility here. Seems to me that giving the bike and scanning it out is a very clear and official transition of responsibility because at that point it’s clearly mine. If I leave my bagpack unattended in the shop, I’m to blame if it gets stolen.
However, Decathlon could have acted smarter than just ‘not my problem’.
Also, I can easily imagine that he asked “can I leave this here for a minute while I grab some shoes”, they said “sure”, so then he would assume they would at least watch his bike.
It’s actually “paid and collected”, not just “paid”. If you go to the supermarket, buy stuff, and then leave it in your trolley unattended, is it the supermarkets responsibility to keep it safe?
I’m assuming hot potato rule: who touched it last?
Did the staff hand it over to the guy, who didn’t lock it?
Dus als ik mijn fiets die ik gekocht heb bij Decathlon binnenbreng voor onderhoud en hij wordt daar gestolen zijn ze niet aansprakelijk?

Does that mean that their showroom bikes get stolen all the time? I thought those are not locked as well.
