Leaked report suggests Dominic Raab trying to curb judges’ powers | Judiciary | The Guardian

  1. Wouldn’t this lead to the government to be able to hand out contracts for fracking rights more easily or give contracts to mates and donors without legal repercussions? Maybe it would stop scrutiny of its own environmental policy which at present is being challenged as it contravenes its own targets set down in legislation. Its a blank cheque to abuse power

  2. Rishi Sunak: “The human rights act was getting in the way of our policies we are trying to put in place… so we got rid of it and made a bill of human rights. Now we dont have to worry about breaking those laws anymore!.”

Dominic Raab: “Judges can hold us accountable…. we need to strip back their powers!”

  3. Isn’t this basically what they campaigned on? I know it’s shitty but if they are trying to do it secretly, they are doing a pretty bad job of it.

  4. Any government who counts amongst its enemies, groups like lawyers, judges, and civil servants, needs a moment of introspection. A “are we the baddies” moment to be specific.

Every ministry finds that its desire to wield power is frustrated by other parts of the system, but that’s exactly how this SHOULD work. Any good political system has checks and balances, some separation of powers, and oversight to prevent the abuse of power. If you spent a lot of your time trying to dismantle those checks and balances, you’re almost certainly trying to facilitate abusing your power.

It’s also just… shortsighted. You won’t be in power forever, and the next lot can take all the increased authority you’ve created and use it to undo everything you’ve done.

  5. I know this is a bit of an aside from this but;

How the heck are reports from inside the MoJ ending up in the hands of newspapers?

Is this not a little concerning to anybody? Who’s leaking this stuff? And if the Guardian can get ahold of stuff, who else is getting hold of stuff?

  6. What needs to be realised is that, like Orban, once a government is in power it is no longer accountable. This is what the Right wing seek in the USA and UK especially. Your democracy, the checks and balances that attempt to preclude a government from being autocratic is being legislated away. And just fucking remember it was Boris Johnson who said to his colleagues “I’m the Fuehrer around here.” Johnson the complete and utterly incompetent failure. And how do you regulate a government?

Theresa May who on being advised by MI5 to investigate Arron Banks because of his Russian connections – refused to do so. Etc etc. Everyone knows Brexit was a shitshow from day one. But if you can sell England by the pound much easier away from EU accountability, to your own people. To the locals you have ties to and get your kickbacks. How much was the PPE scandal – justified by an emergency the government created. You got what, safety, no. You gave away billions upon billions to Tories. And by Tories I mean exactly in the original Irish colloquialism.

  7. My main issue with these “changes” is even if labour gets in power for say, a generous two election tenure of 8 years. What incentive is there to rebalance any power back to the judges or the people like the protest Bill?

Ideally you’d think they’d do it, but these changes let any government, not just a Conservative government to have more power. And as we know with British politics, majority of politicians, no matter what side, can be pretty morally bankrupt at times.

  8. As a disabled person currently part of a group claim against the government this is very troubling. They’ve been stalling for years and it’s gone to 4 judicial reviews because the government won’t pay out the money that’s owed.

    >The judgment in this case represents the fourth time that the Court has given detailed consideration to claims under Article 14 of the European Convention of Human Rights alleging unlawful discrimination against severely disabled adults who ‘naturally’ migrated to Universal Credit.

50,000 claimants owed around 150 million.

  9. This seems greatly concerning.
Has anyone got any other sources that discuss this? From my lefty viewpoint, it seems a pretty clear cut stance that the government is taking the piss given such judicial review cases were warranted but I’d appreciate reading some more about this.

Also makes me want to write a letter to my MP. Some things should not be Partisan and there should be checks and balances in government
