I still have my last phone, it still works, tried to use it with no sim for Spotify the other day and could not remember the password, I’m now on 1 hour cooldowns between password attempts days later and can not for the life of me remember what it is.
How can you reasonably prove someone is refusing to provide a password opposed to genuinely not remembering?

How does asking to see a passport equate to getting the password to your phone?
Remember when Oranmore, Co Galway Garda could not find Barry McArdle, despite calling to see him in Oranhill a few times and he harassing locals.

They need a warrant at least which by that point they would be able to get it from you.

Two minds about this. On one hand a warrant given to search a potential criminals residence is fine IMO, so why would I feel any differently about a phone. Then again, I would feel that this is an ultra extreme form of search and one that should only be reserved for the most extreme offenses, but fear judges would be likely to be much more willing to grant such a warrant for even minor offenses.
Anyone in support of the Gards having the power to demand passwords is simply a bootlicker, they can already stop and search you for virtually no reason, having them be able to completely breach your privacy like this is dystopian.

Garda powers are already extremely wide ranging in Ireland compared to most other Western countries, particularly in relation to stop and search etc. This law is pretty much just a continuation of that trend.
That’s why I will never go to Canada. Border patrol will refuse entry if they can’t access your phone.
